Individuals’ rights to stop activities deemed threatening democratic rule recognized in new charter



BANGKOK: -- Individuals and group of individuals will be entitled to petition the Constitutional Court to stop any activities which are deemed a threat to democratic rule or administration.

The above right is enshrined in a provision of the draft new charter approved today by the Constitution Drafting Committee.

The original version of the clause only recognizes the right of individuals to propose the Constitutional Court to stop such activities but after a debate in the CDC, the clause was amended to include the right of group of individuals as well.

There are two channels through which the petition can be submitted to the charter court – one is through the Office of the Attorney-General and the other is that individuals or group of individuals can directly petition to the court.

Agree to everything you say there but would add it is not limited to politicians who will benefit from such a law. There are other highly influential groups who would love to misuse government processes. I feel what's going on in Thailand at the moment is more about those other groups than about politicians.

Thailand fails repeatedly to write a constitution because they refuse to write laws or rules with clear intent and definition.

This law will be abused again and again to screw with elected govt. The govt will fight it, and eventually there will have to be an intervention from the army,.
