Children no longer exempt from over stay fines.

No I don't have to pay up as i don't have or ever had any overstay.

My experience tells me that you will be surprised with the way it would end up.

if one's right and victim of extortion, he should stand and in the end will prevail. Because they they are wrong and risking in doing it.

It would be good if Thai Visa used their influence to reach out to immigration in Bkk and tell them what's happening and get clarification. It only effects a small number of posters but it does affect them. Ideally the kids should have current visa's but the law states that there are no overstay fines for children under15. It's the charging of overstay fines that is the problem!

Don't you think that Bangkok immigration doesn't know what is happening?

I think that they are sometimes the instigators of many problems.

Unless the "settlement rule" referred to in Section 84 of the Immigration Act has changed, children should not be charged the overstay fine. I have no copy of this settlement rule, which lists the summary fines that immigration officers can impose so that not every infraction of the law has to go to court, and I wouldn't know where to start looking for it if it has been published anywhere.

The question is, is it happening?

I received several reports over the last few weeks that Phuket Airport is charging minors (via the parents) sometimes for overstay.

But it is not happening all the time and looks like that it depends on the officers mood.

When it happens, is a receipt issued?

I didn't hear that receipts where issued.

If you pay a fine you get a receipt. No receipt normally means no official fine.

Now in Laos.

We got our non-b in November last year but my 3 yr old just got the regular 15 day transit visa. I was told by friends that my daughter would not be needing a visa as thailand does not require children to have one.

Last Friday at Udon Immigration, we were told that if a minor overstays more than 90 days, there will be no fine but the said minor will be deported and not be permitted to enter Thailand for a year.

Today at the Nongkhai immigration, the really grumpy officer took one look at my 3 yr old's passport and said: "Baby go overstay!!!"

There was no one there so we waited and when an officer finally arrived, he was was nice and photocopied a page from my daughter's passport then he stamped her passport with what I believe is something that says she has overstayed for 89 days. That was it. No questions asked.

With all the changes happening now, I think it is best to get her a tourist visa then when our WP and visa extension are out, we will get her a non-o visa.

Some immigration officers are not fully aware about children not paying an overstay fine. Also there is no rule about an overstay over 90 days and being banned for a year Immigration made an announcement of it but it was never approved by a higher authority.

You could get her a non-o visa now as your dependent and then an extension of stay as your dependent.

^the immigration officer @udon said this will be implemented soon.i doubt it as well but for some reason i am a bit scared now and have decided to just get her a non-o.

Our hr guy informed us that we need to wait for the work permit and visa extenion to be released before we can get our daughter a non o.

You could get her a non-o visa in Vientiane with just your non-b visas and her birth certificate. She will need one to apply for the dependent extension.

Busy Monday at the Thai Embassy Vientienne today. I asked the hubby to go there as early as 6:30am so the daughter and I could still have at least an hour more sleep. We were number 4 :)

Handed in our non-b documents and the daughter's passport and birth certificate for her non-o. No hassle at all.

I don't know if the overstay banning is approved already or not but Phuket immigration has now installed several official looking posters with the message that people will be banned from returning back to Thailand in case of a overstay.

It certainly has not been approved yet. Just another immigration office putting out false info to scare people.

Immigration came out with the announcement in May of last year. If it was going to approved it would of been done long ago.

In my opinion it has not been approved because it goes against the immigration act that only has the 20k baht max fine. They would hive to change the act that has not been changed since it was written in 1979.

The immigration act does allow for denying people entry based on overstay, but only if certain conditions are met. For example you can be denied entry if you were deported from Thailand on the expense of Thailand, but Thailand never pays for the ticket home. You have to pay for that yourself when you are expelled.

To be fair there to be said however that anyone that still chooses to use Sadao / Dannok when the predatory attitude of some officer (not all) is well known, does that by own will. And that they folded the bluff very quickly no real pressure was given in this case.

I used to love the tip jar at the booths. Positively venal.
