TR Visa TO NB - WP1 or WP3 , maybe t86 valid info

Featured Replies

Hello everybody!

I am swedish 23 old

I Stay currently in Thai with a tourist visa 3 entry (6 months) I have already used all 3 and for each one extension but NOT the last one ( arrive 2 months + 1 month extencion , fly out 2 months + 1 extension , now bus out got 2 months (expire 5 MAR) and maybe I can have the last extecion.

Anyway somebody offer me a job but I heard that a new law come inside , before normally the people apply for a WP1 ( go to Penang etc .. ready with all documents and request the non immigrant B visa , and apply for a work).

But now I heard that now is a WP3 ( if I understand right I need to be outside the Kingdom of Thailand when the Company apply for me because I need a letter for a Ministry of Labor , receive the email and present me at the embassy with the letter and all other documents for apply the non immigrant B visa).

So I have there question

1) is all this right ? and somebody that was recently in my situation can give me advice.

2) There still a possibility to pass with a WP1 in one embassy like Kata bhatu, cambodia,or others ? (heard that Penang,Singapor and the most common are blocked)

3) I hear about this , I have more than one month left so maybe I can converter my tourist visa in one non immigrant B ( applying the module T86 and present all the relative documents (id,company, invitation, etc,,,,) (looks like a good possibility and don't see why not)

Thank you for your time!

sorry for the typo errors .

best regards.

In most case people uses Laos or Penang for non-imm 'B' visa. You a letter of approval from labor office, unless you will work as teacher.

If you want to try having the visa converted, that is not common and they may give you a good deal of run-around. See post below.

You can apply for the WP and will get paperwork from the labour office that you have applied. (This can take some time). With that paperwork and company papers you can next apply for a non-B visa in a neighboring country. Once you have the non-B visa you get the WP.

Conversion is difficult and will be best and cheaper to do in a neighbouring country.

yes this is the normal mode as I understand , but now many talk add do it with the WP 3 you must stay all the time outside the country when you apply because if not, when you apply and they see yours sample in passport and you wasn't outside the denied the request.

I hear about 3 people that do like this , and maybe you need to stay weeks and wait that the company ask for the letter from the ministry of labor, then send to you and when you have you go to apply for the NB visa . ( time, post ,work offici can be weeks I think)

I wait now the company papers prepare my , but I am very confused.

Thank you for the reply

The issue is not the application form used to apply, WP1 or WP3. The point is that at most consulates you need the letter of approval from labor office. In the past, a copy of the form stamped as submitted was enough, now not anymore and you need the official letter. Once you have that and the other paperwork, the consulate will issue the visa. And with the visa the labor office will issue the WP.

Yes I understand like you said but for have this letter I should be outside the kingdom of thailand right? and the company send that to me the letter

Normally you do not have to be outside.

Although I remember a similar case as yours, a short time ago. What labour office are we talking about?

The company can file the WP1 work permit application with you in the country and get the letter of approval from the Labor ministry. There is no requirement for you to be outside the country.

I need to ask the company more information.

It is correct that a WP3 Work Permit Application should strictly only be filed for applicants who are currently outside of Thailand.

However as ubonjoe has already posted above, a WP1 Work Permit Application can be filed successfully whilst the applicant is in Thailand and the Ministry of Labour approval letter then issued to then support a single entry 90 day non immigrant 'b' visa application outside of Thailand.

Today I call embassy in 3 differnt place and all say you need a WP3 and a letter from the minister of labor , so how can I get a WP1 like you said if it is possible ?

Just go to the labour office and tell them you want to apply for a WP. They will give you the forms you should fill in, together with the employer.

Once you have filled the correct paperwork they will give you the required docuemnts to apply for the visa. (You might need to come back at a later time for these documents).

Next week I go with all paperwork and see if I get a WP1 if not I wait the letter ,

You will need both form and letter!

All the nearby embassies and consulates only want the letter of approval for the work permit application nothing else will be accepted.

WP3 is the reference number of the application form as is WP1.

It used to be that the receipt for successful filing of the WP3 or WP1 (A5 sized slip) was ok on it's own, but now all nearby Thai Consular Facilities are also asking for the 'Letter of Acceptance' which is issued by the head of your local labour dept and confirms that a WP is ready for issue once a non immigrant 'b' visa and subsequent 90 day entry stamp is obtained by the applicant.

Below is an example of a WP1 filing receipt. the WP3 variant just has a different box ticked.
