Hi,

I am 42 Year old male from Australia, Married to a Thai National who is living with me in Australia on an Aussie Spouse Visa with a Child on the way (due July)

We will be travelling back to Thailand in December 15 to see Family for about 3-months

I also have a EFL Certificate and wanting to put it to good us when we go back

We also have a Thai Joint Bank Account

From reading the available Visas I am confused as to which Visa/s I should be applying for myself and my Child

As my wife is Thai does she need to also apply for a visa

All very confusing

You should apply for a non o based on marriage or a tourist visa. Tourist visas are for 60 days and can be extended by another 30.

You wife is Thai national and does not need any visa. Your child would be Thai as well and you could get a passport at the Thai embassy.

For a little bit of extra money, i'd go for the 12 month multiple entry non-o spouse visa. That will give you your first 3 months without needing to leave the country, then another 9-12 months (with 90 day runs) should you decide to stay longer. You don't need to show your bank account balance etc when applying for that visa in Australia.

An employer can help you apply for a work permit on the non o marriage visa/extension once you're in Thailand, but not on a tourist visa.

For your child, i'd just apply for a Thai passport in Australia once they are born, rather than getting a visa. Wife does not need a visa.

From the reading I have done Type O is only if you are over 50 & a working / travel visa is if you are between 18 & 30

We are planning to get dual passport for our child but on this trip our Child will be on an Aussie Passport to play it safe

I don't know where you got that information, but most, if not all of it is wrong.

Is dual Passport better than Single as I would like my child Recognized as Aussie also so that I know my Child can come home with me.

Heard many tales of Children of a Foreigner by taken by a Thai family and nothing can be done. I do have very good confidence this will not happen just want to protect myself and my child as a just in case

There are different type O visas. One of them is retirement, another type is to visit family (you don't have to be over 50). On your link to the embassy they refer to it as a 'spouse visa'. As long as your wife has a copy of her house registration, you'll be technically visiting her at that address - even if she's living with you in Australia.

Playing it safe would be having both passports for your child. You should enter/leave Australia on the Aussie, and enter/leave Thailand on the Thai passport. If that makes sense. Your child can apply for a non-o visa if you don't want to get him/her the Thai passport.

You need need apply for a Thai birth certificate at the embassy in Canberra or the consulate in Sydney and then a Thai passport for your child. Info: http://canberra.thaiembassy.org/consular.html

Also get them a Australian passport. Then leave on their Australian passport and enter on their Thai passport.

You wife will have to use her Thai passport.

You should get yourself a single or multiple entry non-o visa. You can get a work permit and work on a non-o visa or extension of stay based upon marriage.

Anyone can get a tourist visa. No age requirements or limits. Many reasons to get a Non-imm O. No need to be over 50.

Maybe you're thinking of a non-imm O-A, which is generally thought of (incorrectly) as a retirement visa.
