webfact
Lawyer cries foul over search and trailBANGKOK: -- Lawyer of former prime minister Yingluck Shinawatra today called the search of her motorcade and the monitoring of her movement an infringement of her right and liberty and also a violation of her privacy. The lawyer, Norawit Laleng, said such violation by police and soldiers should stop now as it was tantamount to putting her in custody. He recalled the incident last Tuesday in Chiang Mai while she was travelling in a motorcade from her home to pay homage to her ancestors at Wat Rongtham Samakkhi temple cemetery in San Kamphaeng district.Soldiers from the Third Army Region and police stopped her motorcade for a search. However the former premier gave cooperation in the search to show her sincerity, he said. But after the incident she again was followed by police and soldiers wherever she went in Chiang Mai.Besides, the night before, a military vehicle with soldiers also parked in front of the housing estate in Mae Rim district where she was staying, he said. This was an indirect following of her movement and was tantamount to keep her under custody and was an infringement of her privacy, and deprived her of right and liberty. The lawyer said if this practise was a matter of security measures provided for a VIP as claimed by some senior security officials, she should be notified beforehand, he said.He went on saying that the former prime minister has abided by orders and conditions laid down by the military junta whether in the country or abroad and never created any trouble. He then called that the police and the military stop infringing on her right and liberty and respect her privacy protected by the constitution.(Photo : Thai PBS File)Source: http://englishnews.thaipbs.or.th/lawyer-cries-foul-search-trail -- Thai PBS 2015-02-11
webfact
Yingluck's Lawyer Urges Junta to Stop Intimidating HerBy Khaosod EnglishFormer PM Yingluck Shinawatra (in green) praying at a temple in Chiang Mai on 10 Feb 2015.BANGKOK — Former Prime Minister Yingluck Shinawatra's lawyer has asked the Thai military to stop trailing the former leader, which he called an infringement of her rights to privacy and freedom of movement. The lawyer, Norawich Lalaeng, was referring to the soldiers who stopped and searched Yingluck’s convoy in Chiang Mai province yesterday and followed her for the rest of the day to a temple and market. While the military insisted that the soldiers were merely providing security, Norawich said Yingluck never requested the "protection," and felt threatened by the gesture."The police officers and soldiers followed her all day. Even at night, soldiers were posted around her residence," Norawich told Khaosod today. "Such action may not have been a direct attempt to detain her, but it could be seen as indirect detention. It infringes on her privacy, and it restricts her individual rights and freedom. If security forces want to provide us with VIP protection like they said in the news, they should coordinate with us directly, so both sides will be relieved." Popular Post The manic
Soviet/Nazi style abuse of procedure to harass and bully whilst cloaked in legality. A disgrace. It happens all over the world an is used by police and bureaucrats alike. A new low for this regime but there will be more abuses of a wider range of people. Every day she is looking more and more heroic and dignified. It is no wonder that the people's admiration of her is genuine and not enforced by dictate and law. This is how SLORC used to bully and browbeat Aung San Suu Kyi in Burma. But even they did not resort to the sexual slander and sexist abuse used by the yellow shirts to attack the then Prime Minister of Thailand. webfact
Stop undermining Yingluck’s freedom: Ex-PM's LawyerBy Digital ContentBANGKOK, Feb 11 -- The lawyer for former prime minister Yingluck Shinawatra has urged the military to stop threatening rights of the former premier, pointing out that she should be allowed to travel overseas because a formal indictment against her over the controversial rice-pledging scheme has not been brought to court.Norawit Lalang said today that Yingluck has cooperated and strictly complied with orders of the National Council for Peace and Order (NCPO) since the May 22 military takeover and the nationwide declaration of martial law.Whether she is in Thailand or overseas, his client has never done anything that would lead to unrest in the country, he said.Sources said that the NCPO has already rejected a request by the former premier to visit Hong Kong, China and the UK from February 10-22, reasoning that she must attend a court trial.Mr Norawit said the Attorney-General has announced that it would take about a month to draft an indictment against Yingluck and the lawsuit should be formally launched with the Supreme Court's Criminal Division for Holders of Political Positions within March.Ms Yingluck understands that she should have the right to take the overseas trip from February 10-22, he said.“The Office of Attorney General (OAG) has already said that it has no power to prevent an individual from taking an oversea trip unless an indictment against the defendant has been brought to a court, “ he said.“I am asking the concerned authorities to stop undermining rights and freedom of the former prime minister that she is entitled to under the constitution and legal procedure,” he said.On the military’s close monitoring on Ms Yingluck, Mr Norawit said it undermines and restricts her personal rights and freedom.Ms Yingluck’s van was closely followed by security officials and her motorcade was reportedly stopped and searched at a checkpoint yesterday when she was in the northern of province of Chiang Mai to join a merit-making rite for her ancestors.“This is like Ms Yingluck is indirectly detained,” Mr Norawit saidHe said if the army considers Ms Yingluck as a ‘VIP’ figure and wants to ensure her safety, it could directly contact and inform her. Popular Post Tatsujin
Rightly or wrongly, we're under a state of Martial Law, so the lawyer can complain as much as he wants, but the current Govt/Military can pretty much do whatever they want and not be "in the wrong" for it currently. P.S. - I'll remember to give nice old Khun Norawit Laleng a call next time the RTP stop me, search my vehicle and ask me to piss in a cup at the side of the road. I'm sure he'll be most pleased to take up my case of infringement of civil liberties, stereotyping and unwarranted search etc etc. Edited February 11, 2015 by Tatsujin

WhizBang
"He then called that the police and the military stop infringing on her right and liberty and respect her privacy protected by the constitution." Perhaps he is unaware that there is no constitution at the moment. It is being rewritten. "On the military’s close monitoring on Ms Yingluck, Mr Norawit said it undermines and restricts her personal rights and freedom." Again clueless. Under military rule there are no personal rights and freedoms.

I am not a political supporter of yingluck. I am a supporter of each human being treated fairly and justly. Normal people here in Bangkok are daily stopped by police who want to study their faces, look at papers and even look inside the car. Should we tell the army to let the police do their work? Ms. Yingluck is requested to appear at court on the 19th. Ms. Yingluck is know to exploit situations to garner support for her (like at the funeral of that dear departed red-shirt a few months back). Ms. Yingluck doesn't behave as your average normal human being, so why would she or her lawyer complain when she's not approached like one? Maybe Ms. Yingluck's lawyer should tell the NCPO that democratic countries are exploring 'less' intrusive ways of keeping track of people and even manage the people to volunteer. "For example, applications could expand beyond access and include employee ID and location tracking." http://www.computerworld.com/article/2881178/office-complex-implants-rfid-chips-in-employees-hands.html?nsdr=true

If the military really wanted to turn her into the martyr that so many of her supporters wish, maybe they could confine her to her Lard Prao estate and make sure there is a large table on the inside of the gates so that she can stand on it and try and wave to her fans in the inimitable, classic way that Aung San Suu Kyi did. Mustn't forget the flower in the hair. Any other comparisons between The Lady & Yingluck Shinawatra are tenuous at best. ASSK was never in the same legal position as Yingluck.

Popular Post borisloosebrain
The sort of harassment , legal, violent and otherwise that her family and its goons dished out to journalists, business rivals, and rival politicians I have zero sympathy for the woman. She is a high flight risk candidate who when she was informed of the extent of corruption and financial losses caused by the rice scam she directly oversaw, did nothing except fire the whistleblower. She allowed the despicably corrupt Chalerm to oversee the police force <deleted>.the woman has no respect for her fellow thais, only in what they can do for her and her familys interests. She is however very cute, maybe that blinds some people to the extent of her misdeeds. Edited February 11, 2015 by borisloosebrain
