No, the question is the difference between the two.

And that difference through recent history stumped the US Supreme Court in their attempts to render a decision as to what can and cannot be considered as smut [read the P word here].

Given the Thai's level of respect for the US justice system, I'm sure in a case like this where all is as clear as mud they're more than happy to render a verdict of mai bpen rai :o

And actually, many quality erotics would not necessarily fall under what is deemed illegal by Thai law.

- pirated copy or sold without consent of owner = illegal

- not passed by the film censor and given a rating = illegal
