Without your child being registered in a house book you would not be able to the change to a non immigrant visa or extension of stay. Does he have a Thai birth certificate and a Thai passport?

If you are still married to his mother you also cannot apply for one.The extension of stay as a parent of a Thai is only for a single parent.

Yes I'm still married to his mum but we have split up and she lives in the UK so yes I'm a single dad. I have his thai passport and thai birth certificate and can try to get him on his grandparents house registration will I be able to get an extension of stay because his mother is in the UK and has no plans to return to Thailand

Immigration will not consider you to be single until you are divorced.

It will be difficult to get the divorce done here. She would have to sign the the divorce agreement and other documents at the embassy in London.

If you get him registered on a house book you can get 60 day extensions to visit him at immigration. You could also get a single entry non-o visa at nearby embassies and consulates.

What if we got divorced in Thailand would she have to give me parental custody?

Yes, she could release sole custody to you. There is no limit to the number of visa you can obtain.

Your wife does not "have" to give you custody of her child.

She can contest custody, agree to shared custody or concede custody to yourself. Her choice.
