Hello,

We have entered Thailand with our family with a single entry Non-O visa. Within a few weeks I will apply for extension of stay based on retirement (Non-OA) for my wife and myself (I am 50 and my Dutch wife has a Non-O based on being dependent), but I am not sure if I also have to apply for an extension of stay for our child (3 years old). Are we obliged to ask for an extension for him too (I know kids below the age of 14 don't do visa runs for example)? Some say yes, some say no. Couldn't find the answer to that question here, so sorry if asked before.

Anyone any thoughts on this?

Thanks.

Per law, any foreigner no matter the age must have a valid visa or extension of stay.

Minors of 15 are not fined for being on overstay.

Your choice really.

A OA visa can only be issued by your home county not inside Thailand. Your on a single entry O visa so can apply for an extension to stay based on retirement this not a visa. Your wife can have a non O based on being a dependent and your child being under 15 also can have O visa based on a dependent. None of you will require a visa run, you do have to report to immigration every 90 days.

Both your wife and child should get extensions of stay as your dependents. Does your child have a non-o visa now?

Children under the age of 15 do not pay overstay fines but do get overstay stamps when they leave the country. Not having to pay the fine does not make it legal to stay in the country without a valid visa or extension of stay.
