Hi guys,

I had a job offer from a company in BKK.

They applied for my wp3 and the letter of approval is also done.

I than came here on non immigrant B , so that the company can apply for my work permit.

The medical is also done on FRIDAY and its clear.

now the point is that will the THAI gov. will take my passport until they issue me a valid work permit ? or they will take it look at it and return me back ? actually I don`t trust on any one can`t give my passport to any one also there are long holidays coming from FRIDAY , the company HR said that they will apply for my work permit on TUESDAY , is this safe or not , if the THAI gov. will take my passport and didn`t return me I will stuck here for long days just want to be clear that will they take it when they assign u a work permit or they just take it look at it and return it back ..please help ...the HR said that they don`t know whether they will take it or just hand back to me how can it be possible anyways I had to be careful in any means pls help.

Any help would be appreciated thnX.

I don't recall my PP being held at any point during the WP / Extension of Stay process.

I just give all the documentation to our HR lady and she does the business, have to visit immigration each year, but I've not been to the labour department for ages.

Just make sure you have copies of the relevant PP pages and the WP3 receipt just in case.

The HR is saying that u had to come tomorrow to join our office mean while we will work for your WP and u had to give us your passport that thing is scaring me a lot :(

Scared of what? If they go to the labor office without you they need to take your passport. You can go as well if you want but what's the point.

HR will need to show your original passport, but the labour office will not keep it over night. For that they have the copy of your passport, they merely check if the copy is confirm the original.

I tell you what, if you go to a foreign country and don't trust your future employer to handle your passport as required by the law, maybe you should rethink the entire concept of moving.

IS the company you now work at reputable? Does the HR person know what s/he is doing? Are you the only Westerner working at that place?

Sometimes, when you have your renewal processing, the HR people need your documents ready to go.. forms to fill out, you need to sign every single piece of paper.

Maybe on your first time, you go down to the immigration and work permit office and process in. Then maybe depending on your liaison person you just sign off and your passport and work permit books are required so you give them and you will have them returned stamped and you're good to go for the year.

Very important not to PO your Thai Liaison process, they (she) has to process you.

hi ..we went to the department of work permit and they issued me the same day but the new problem is that my company keeps it and they just gave me a photocopy of it ...need to confirm from u guys is this legal....pls tell me I ask them they said that its the rule of the company to keep the original one and only photocopy can be issued to the employee.

Although technically speaking the WP is the employees a company holding the original wp is not unusual, and if they have paid for it I guess it kinda makes it theirs, I wouldnt sweat it to be honest a copy is more than adequate in most cases

You may need your work permit to open bank accounts perhaps, but apart from the rare occasion that this will happen, the WP isn't really any use to you outside your working environment.

Don't forget, it is issued for working in the one place, ie, your new employers shop, and unless your job requires that you travel around, it is likely safer there in the hands of the company. Perhaps the reason of their policy towards WP's?

I thought by law your work permit has to stay at your place of work. Ours ( 4 ) are kept in the accountants safe and she will give them to us if needed for anything. I keep a copy and during my visits to many different companies in Thailand have never been asked to show it.

You really need to calm down and stop sweating the small stuff or you'll have a heart attack .

Mr Hatter, inside the Wp it says it must be kept at the place of work or on the holder

No, by law the work permit has to be kept by the employee, not the employer.

So you will be so good enough to quote the applicable section in the labour act or other law which states this then ?

I went to the Labor Office to apply for a WP in the morning and got it

on that afternoon, and I still keep it now.

"Section 24

A Work Permit recipient must have the Work Permit kept on him/her or at his/her working

place during the working hours to be availably produced to the Competent Official or

Registrar at all times."

The single biggest problem in communication is the illusion that it has taken place

But that doesn't say the employer is legally obligated to retain the WP, what is written there makes perfect sense, all that says is the WP must be available for inspection if so required

Not strictly correct. I have 2 locations registered on my WP.. One in BKK and the other in Pattaya. I have my WP in my office and it travels with me to either location.

It is an either/or requirement, but in both cases the obligation is on the work permit holder: he, the work permit holder, must keep the work permit on him; or he, the work permit holder, must keep the work permit at his place of work during working hours, not the employer. In the second case, the employee could keep it in his desk or for example give it to the accountant or the HR manager or somebody else in the company to lock away safely. Of course, you would have to look at the original Thai text to verify the exact meaning of this legal clause.

I remember a case reported last year in a Phuket newspaper where a Russian tour operator was held by police for questioning but was released without a fine after somebody else brought her work permit to the police station for examination.
