Jailed Russian businessman and herpetologist Nikolai Doroshenko is set to be released on bail following an Appeal court ruling on Monday, though criminal charges levelled by his nemesis, fugitive former oligarch Sergei Polonsky, remain.

The Sihanoukville expatriate was jailed on March 25 after failing to appear in court over charges filled by Polosnky, his former business partner, related to one of several land disputes between the pair.

Presiding judge Khun Leang Meng could not be reached on Monday afternoon but both Polonsky's lawyer Benson Samay and Doroshenko's son Ostap confirmed that Nikolai had been granted bail.

“I'm waiting for when my father comes out and then we will speak with the lawyer and then we will make plans [as to] what is the next step,” Ostap Doroshenko said on Monday.

“My father has stayed in the prison one month already so we are going report [Polonsky] back [to police],” he said, adding it was time for Polonsky to go to jail for the false charges he had filed against his father.

Polonsky's lawyer Samay said he was speechless upon hearing the bail decision and warned that Doroshenko holds multiple passports.

“He wanted to flee this country since a long time ago as he has collected money to build a house at Chonburi [province in Thailand] and he also has no money to pay Polonsky back,” he said.

Polonsky is himself wanted in Russia on multimillion dollar embezzlement charges but has thus far escaped extradition. In 2012 Polonsky was jailed for allegedly forcing a group of Cambodians overboard at knife point but later released on bail in a case that has never gone trial.

Russian still jailed despite bail

Jailed Russian businessman Nikolai Doroshenko is yet to be released on bail despite an Appeal Court judge ordering that he be set free on Monday.

Appeal Court prosecutor Ouk Savuth has filed a complaint with the Supreme Court regarding the decision to release Doroshenko, the nemesis of fugitive Russian tycoon Sergei Polonsky and owner of Sihanoukville’s Snake House restaurant.

As a result, his release now “depends on the Supreme Court”, Doroshenko’s lawyer Nach Try said. He added that Doroshenko’s passport had been deposited to secure his release.

The Russian herpetologist, also a Cambodian citizen, has been imprisoned since March 25 following a complaint from Polonsky alleging fraud in relation to a land dispute.

Tan Naret, the deputy director of Preah Sihanouk Provincial Prison, confirmed that Doroshenko remained behind bars due to the prosecutor’s appeal.

Neither Appeal Court judge Khun Leang Meng nor Savuth could be reached for comment.

Polonsky’s lawyer Kaspars Cekotins said the decision was due to Doroshenko’s alleged intention to flee the country, and that he “has nothing to bail with”.
