The person has been here for almost 2+ months now staying in Chiang Mai. Here first on 30 day arrival, and then did an overstay of 15 days. He went to Immigration and cleared it up. He stated they gave him the fine and then stamped 30 more days which I am not sure of anymore. I thought 15 total was all that was allowed, but he states 30.

Next week he is scheduled to fly back to his home, but once again a new problem due to stupidity. When I just spoke with him he stated he was now on a fresh 2nd overstay into it 6 days tomorrow to be the 7th. He thinks he can just go back to the immigration clear the overstay and get a fresh reprieve then be able to fly out.

1. Do they give 30 day stamps now from immigration after you pay overstay?

2. Do they allow a second time going back to clear overstay #2 and then stamp more days?

3. What are his options. If he goes to Mai Sai, will he be allowed to step over and back without showing any money? Or allowed over in any case?

4. Is his best option to let it slide stay under the radar and then pay at Suvanabhumi on the way out?

To add to the dilemma, he has been in and out of Thailand including stepping over the border 6 times in that last 2 years. Will they red stamp him?

I would appreciate some answers so I can print and show him what his options are from the people who are current up[ to date on the rules.

I used to try and help take care of him because of my really good friends request, but this time I have left him alone until now but find the need to at least keep him out of the worst scenario.

2. Probably not. The most he would get now would be 7 days to leave the country.

As much as this kid is a pain, I still want o see him skip out without any gravity. Please give your best opinion. Thnx

I guess the biggest thing is, does he stand to get arrested if he goes to Chiang Mai immigration again. This would be a back to back overstay with no real excuse.

If he goes to Mae Sai, sounds like a crap shot not in his favor.

If he goes to Suvarnabhumi upon trying to get home, is this the best antetode? What is the worst they could do there?

Arrest for overstay is possible, but not very likely if he goes to immigration himself.

- He can try to leave at Mai Sai and return, with the possibility that he will be told to use another border.

- He can leave the country by air from CM and pay the overstay at CM-airport and then return either by land or air.

- he can leave as planned from BKK.

With an overstay you will be arrested if immigration checks you at the street. This can happen, but doesn't happen that often.

2. The 7 day would be after he pays for the days he is on overstay. They would not give the 7 days until he paid for the overstay and the 1900 baht for the extension application.

Best to wait and fly out to the country or fly out and back now.

I agree, and at this point with his dwindling cash on hand, makes no real difference if he goes Tuesday to immigration @ 3500 bht fine + 1900 =5400 total or waiting and paying on spot fine 5000bht at the airport.

The Best answer again is a crap shoot for him. Wait it out, get to Suvarnabhumi without any problems and deal with the overstay issue with the nice gents there hoping for no repercussion (they always will have something hard to say), or go to immigration here, hope no problems getting it squared away and then go to the airport having no overstay and clean to leave.

I leave it up to him, but if my choice in his predicament, I would clear it up Tuesday rather than dealing with the guys at the airport who will ask all sorts of questions of what you do, why you come here, why you come much, etc.. They seem to act more harsh and in your face at the airport than at the immigration office. Last time last year I did a re-entry permit before flying out to Vietnam for a few days. Even though that was above board, the questions were not. Do you agree?

I - overstayed many times but always short,

I - would not go to the Immigration, I would be on low profile until i reach the airport and pay the fine there.

I do not know what bad experience you had in airport immigration of Thailand, I had only positive experiences there and some not so nice stories on in land Thai Immigration offices and on land borders.

So, my advice, do not go to the Immigration, make your fine payment in the airport.

Keep low profile until than. smile.png

I tend to agree. The worst that could happen is they put him in the "holding area", until he coughs up the appropriate penalties. They probably won't delay his flight....but I would make sure he has access to some goodly amount of money.

He might just not bother coming back...if he is planning on breaking all the rules.

awww...you ruined the fun. But I think he will get out at the airport...with penalties.

A friend of mine visited Thailand a few months ago and they had planed a short trip to Cambodia, but things changed and they did not wanna leave Thailand at all. They could have gone the the immigration to get another 30 days, but spending one day to get 30 extra days when they needed 3 felt a bit awkward, so we called 1111. After describing the situation they suggested to stay on overstay and bring cash money to the Airport when it was time for them to go home.

Apparently it was very smooth for them,

IO: "You are on overstay!"

Friend: "Yes."

IO: "You have money?"

Friend: "Yes."

IO: "Go over there pay overstay."

Friend: "Ok."

nu fuzz, no delay, and Actually i believe it became cheaper, 1500.- / person vs 1900.- for 30 days at immigration.

Gentlemen. All is needed to be known is if he can go to the CM immigration again now on 2nd overstay without the worry of being apprehended. Paying the overstay here and then 1900 for a 7day free exit card is well worth not having the worry going the 9 yards to Suvarnabhumi through pay the immi on the way out.

Yrs back back in the day, I did have 2 overstays, but they were at Don Meang and 2 passports ago.

nzexpat. Yes, I fully agree with you. Words to the unwise can only go so far and then that person, him, needs to stand on his own two legs and take responsibility by the horns or face the piper. Unfortunately, in this case, he told me early last night that the money sent to him by Western Union from his family friend is already half gone. Will be interesting because he knows now after too many times of him coming here that I will not go any further than asking for immigration advice.
