Marriage visa will expire while out of Thailand. How do I reply upon return?

Featured Replies

Hello Forum,

I could use some advice.

Last year I successfully extended the "O" visa I received in the US into a marriage visa that will expire August 1st, 2015 while I am out of Thailand.

I'll be in Europe (not my country the US) from June 10, 2015 through September 30, 2015.

I'll return directly to Thailand on October 1, 2015.

My Thai marriage visa will have expired 2 months earlier, and I'll reenter, I presume, on a tourist visa since I did not go back to the US to get a new "O" visa.

Any ideas as to how I would get a new marriage visa under this scenario?

Can I reapply for a new marriage visa based on the old one, even though the old one expired and I had to re-enter on a tourist visa, and not an "O" visa I think I had to only get from my home country?

My wife, and three kids are all Thai and US citizens if that somehow matters.

Thank You

You can apply for a Non Imm O visa at a Thai Consulate prior to returning to Thailand. It doesn't have to be obtained in the USA.

When you enter Thailand, you'll be given 90 days permission to stay. After about 60 days, you can apply for a 1 year extension at the immigration office that services the area where you live.

It depends a bit on the consulate where you apply for the single-entry non-O visa but at most a copy of your marriage certificate should be enough. If a consulate wants also a copy of a confirmed flight out of Thailand you can explain in a covering letter that you don't have it because you will apply for a one-year extension of stay, for which you qualify.

The single biggest problem in communication is the illusion that it has taken place
