Current situation - On a NIB w/ a work permit. Most recent 90 day report was about 25 days ago.

I just started a new job & was told in order to process everything I'd need to first cancel my current visa/wp and then go to get a tourist visa. Once I have my tourist visa I'll be able to apply for a new B visa and wp.

Is this all correct?

What's my best course of action for switching my current visa and getting a new one? Money is a bit tight at the moment so what is my cheapest and fastest option for getting the toursist visa?

FWIW - In my passport I have ONE Thailand tourist visa, ONE Thailand NIB visa, and ONE 30 day exemption stamp. I've also got ONE Laos tourist visa. So it's not like I've been changing visas every month or anything (been here for just over a year).

You are apparently on an extension of stay not a non-b visa entry otherwise you would not be making 90 day reports.

Your extension ended on the date you left your other job. Has the work permit for that job been canceled?

Your new employer can submit an application for your new work permit with your current extension of stay and get a work permit application approval letter for it.

It is possible to change from one job to another by the new employer doing the work permit application and then on the date on a termination letter from your previous employer to cancel your extension and then apply for a new extension.showing the approval letter and documents from the new employer.

Not sure what you can do now.

You can get a single entry tourist visa without a problem if needed.

My wp has NOT been cancelled yet. My last employer agreed to leave it be until I better know what I should do. They'll cancel or provide the cancellation letter whenever I need basically.

I will message my new employer about this second part, it sounds much cheaper and more convenient than leaving the country.

I certain the non-b you have in your passport expired long ago. If you look in your passport you will find a stamp immigration did that an extension was done.

Calling is an extension a visa is commonly done but is not correct.

Immigration is saying what I said needs to be done. You need to cancel your exertion and apply for a new one.

Ok...so your on an extension of stay, not a B visa, on your last day of work, your extension is invalidated and you need to leave the country, unless you pay THB 1900 and will get a 7 day extension,

if the planning is done properly with your new employer, you leave the country with the new company paperwork and get a new Non-imm B and come back and redo your extension.

I theory at least it's sometimes possible to change employers without leaving, but in practice leaving the country getting a new B visa and starting all over usually easier

Thanks. THis is much clearer. Two more questions - where do I pay the 1900 for extension? If I stay past one day will I just pay an overstay fee when I leave?

And in regards to the new non-b.. My boss told me the paperwork was declined because I currently have a non-b (like I mentioned earlier). She said my only option was to get a tourist and then come back for a month or so and THEN go get a new non-b?

You pay the THB 1900 at immigration for the 7 days

I think there is some confusion here, typically Non-imm B are issued via an embassy or consulate, I suspect your new boss has tried to get you a new extension, not a B and has been told you already have one, so immigrations response is correct, everything needs to be cancelled before getting the new one, which typically requires a trip out of country.

1. last day of work a old company, employer cancels all your paperwork with them

2. 7 day extension from Immigration for you

3. New company gives you all the paperwork to get new single entry Non-imm B/WP

4. Travel outside Thailand get new Non-imm B issued from consulate/embassy

5. Come back to Thailand and New company applies for new extension

how many days ago ?....lets assume they have informed immigration and your extension has been cancelled as well

Your work permit being canceled does not mean you are on overstay. Only if your extension was cancelled would you be on overstay.

If your former employer would give you a termination letter you could cancel your extension and apply for a 7 day extension.

Otherwise you should just leave the country and return on a tourist visa or a visa exempt entry. You could do this by air or at any border crossing other than Nong Khai or Mukdahan.

My WP was cancelled on June 23

I'm not sure if extension is cancelled? They sent me a copy of my WP cancellation paper but nothing about termination.

Tentatively I'm planning on flying to Penang this weekand and getting a 60-day tourist visa in order to come back and apply for a new non-b. Just wondering if I should expect a ~7k fine when I leave.

I don't think your extension has been canceled.so there would be no fine when you leave.

Employers are normally only concerned about the work permit because they are limited on the number they can have issued.

Yeah I just spoke to the old employer again and they said I should be fine. Still going to go change to a tourist asap so I can apply for a new non b though.

You don't need to be on a Tourist Visa.

Assuming you are not a teacher, then if your new employer has successfully filed a WP application, with the correct papers you can get a Single Entry 90 day Non Immigrant 'B' Visa at a Thai Consular Facility, then collect your WP once you are stamped back into Thailand on your new 90 day single entry non 'b' visa.

Once you have your new WP you can then legally work for your new employer.

why don't you get the paper work off your new employer for your B visa and go an get the New B visa ?....instead of messing about with tourist visa's

Perhaps the question to ask is does the new employer ever intend to produce paperwork for the visa/work permit ?

Do not forget that as an employee it is you that carries the risks associated with working illegally.

Employers don't really know. They go with what they are said in the past, for different situations, etc. You will need to find a way to explain how things are done correctly without getting in a difficult position.

honestly they are talking rubbish...they can give you the paper work for the B visa, no need to get a tourist visa first

It is highly likely there is no prepared paperwork.

The instruction to obtain a TV is a time buying tactic at best .............

Three possibilities:

1) Your new employer's HR Department don't know what they are doing; often the case.

2) They want/have been 'advised' to follow the somewhat complex TM 87 process to change a Tourist/Visa Exempt entry into a 'B' visa in country, based on your potential eligibility for a one year extension for working in the Kingdom of Thailand..

3) Your new employer does not want you to have a WP (and thus be a legitimate employee with tax/national insurance due), certainly in the next three months, or possibly ever.

Either way, work with out a WP and you risk, arrest, detention, court fine, transfer to the IDC and deportation, where's your employer just risks a fine.

First off they will be providing a WP (and insurance). I am working at a school along with roughly ~15 other foreign teachers. I'm the newest hire and all the others are already on work permits. I'm not worried about that.

I think the confusion is that my employer intends on me getting a tourist visa, and then when I return taking me to Changwat (sp?) to change to Non B. At least that's what the other teachers mentioned. Does that sound right? Assuming I apply with 21 days left then that shouldn't be a problem, right? I've been pressing to get the Non B out of the country, but it's like talking to a brick wall. A really dense brick wall.

What countries do same day processing for tourist visa? I was told Malaysia did but I just spoke to someone there and they said it now takes two days.
