Overstayed or not ?

Featured Replies

Hi guys,

Just want to say that its awesome to find such forum. I'm having problems finding answer to my question so hopefully I might get some help here.

Situation - I have been working in Bangkok legally since 15th Sept'14. My 1B visa has been issued abroad, in the Philippines where I worked earlier. Visa is still valid and expires August 17th 2015.

I quit my job last week (work permit until October 2015).

I plan to leave country this Saturday 8th Aug and fly to Taipei from Bangkok.

Will I be charged for overstay ?

- reason I'm asking is because last stamp I got was on 8th Mar allowing me to stay until 5th June (just found it now accidentally).

I never checked these stamps before (got a few of these earlier when I was travelling in and out frequently). I was always using my 1B visa as a reference which I don't know if it was my mistake or not. Clearly don't want to pay 20k baht.

Looking forward to your responses.

Best

Maciej

Looks as though you have been on overstay since 5th June.

Fine is 500 Baht a day with a limit of 20,000 Baht.

you won't pay 20k but certainly something around 13k ... I'm afraid you can't avoid to pay that much...

I apologies for my miscalculation, I dunno why i've multiplied 500 by 27 instead of 57 ... you definitely have to pay 20k

Thx guys for prompt replies!

Any way of getting out of it ?

- I really did not know I have to be leaving the country every 90 days if I work here full time. For me it just doesn't make any sense (?)

sadly no way out

You must have been in a one year multiple entry business visa. You have to leave every 90 days and reenter, no need to get a new visa until the old one has expired. Usually if you have a work permit, they will extend your stay until the work permit expires, but you have to go to immigration to get that done. You failed to do that, so will get nicked for ฿20,000.

You should just feel lucky if you don`t get yourself into any further mess out of this. Your way out of it is to pay the fine at the border.

Many before you have been caught up with reality, and sent to IDC in Bangkok for the overstay.

Just think of it as a lesson, pay the fine, and be happy you avoid that.

Thanks for the replies. Yes, its multiple entry business visa.

I was at BOI today and got same answers as all above.

It's clear to me that I will have to pay 20k. What is not clear to me is how should I have known about it. I would have never thought that while being legally employed in any country I'd need to be leaving the country every 90days. That doesn't make any sense to me, nor such information was stated on the visa.

I'll try to get reimbursement from the company.

Cheers

it clearly states on the visa website and on your entry stamp that your visa requires a 90 day leave of the country.

You're wrong and must pay the fine. Next time just read the stipulated terms of your visa.

Your passport was stamped by Immigration telling you how long your stay was.

It is there for a reason.

Down to you to look at it, not your company.

Sorry.
