Beer drinker sues Miller Brewing Co for misleading Foster's advertising

NEW YOR: -- A DISGRUNTLED beer aficionado is suing Miller Brewing Co. for misleading him into thinking Foster’s Lager was brewed in Australia.

New York man Leif Nelson, 37, has filed a lawsuit against Miller Brewing Co. in the Brooklyn Federal Court, claiming the company’s advertising for Foster’s Lager misled him.

He pointed to the company’s slogan “Foster’s Australian for Beer” as giving a false impression that the beer was from Australia.

Nelson was a loyal Foster’s customer from 2012 to January 2015, and says he will start drinking their beverages again if they are correctly labelled.

Well, if the punctuation was right, there would be no confusion.

Foster's: Australian for "beer".

But even as it is (as reported in the OP), I don't think there is a case for claiming it misleads one into thinking about where the contents of the bottle or can were made. The slogan is all about the name.

Hoover: American for "vacuum cleaner" . Maybe made in Thailand, though.

I can't understand why useless old trolls on TV frequently take every opportunity to degrade Americans.

It seems that you are obviously the Queen of good grammar with great ability in expressing yourself, not!

Wouldn't he have to prove that he suffered a loss?

I do sympathize with him, though, since I always thought it was an Australian beer.

It would be like finding out my favorite Mexican cervezas were all brewed in Cleveland.

Good on this guy for keeping those rotten corporations in line.

And good beer is good, whether brewed in Australia or....... Germany, Belgium, New Zealand, Britain, or Denmark.

Good point.

Perhaps the argument is because of the price over the counter. If all these years he's been paying 50 cents more for a six-pack than he would pay for Miller or Bud, because he thought he was buying imported beer, then he may have a point, and he may have suffered a loss.

I still think his lynchpin of the slogan will fail him, and rightly so.

There is a previously mentioned country, conspicuous in its absence from this particular list. I do believe that was the point.

Because any nationality that would sue a beer company because the advertising made them believe it was made somewhere else deserves to be trolled ;)

Fosters was an Australian brand that was first brewed by American brothers who came to Melbourne during the gold rush. Subsequently, one bloke in particular ( Jack Elliott) was going to take it to the world, especially UK, where there was a drastic shortage of drinkable beer in the 70's, unless you tracked down regional ale specialists. Unfortunately, a couple of bankruptcies later he was well out of it. Now owned by SAB Miller which is either South African or American. By the way I rarely see Fosters in OZ these days.
