My 'friend' wants to clear his 4 month overstay at changwattana. Will they let him apply for a 3 month 'have kids' visa there straight away or will he have to leave the country?

They might send him to the IDC if he goes to CW with a 4 month overstay.

Best he leave the country and pay the 20k baht fine at the airport on departure.

He could then apply of a single entry non-o visa based upon being the parent of a Thai.

Steve.. If you got kids you can get a 3 month stamp at any immigration in Thailand for 1900. I've done it lots of times. Can extend 2 months.

Some border crossings will not clear long overstays. There is also the risk of getting caught on the way to the border.

It would be best if he got a single entry non o-visa instead of a visa exempt entry. He would only get 15 days at a border crossing unless he is from a G7 country.

The only Myanmar crossing the will allow a out/in for a visa exempt entry is Ranong. All crossings to Laos allow them.

In order to get a 3 month visa at immigration requires the same financial proof and supporting documents needed for a one year extension.

Only a 60 day extension to visit a Thai wife or child can be obtained.

The border at Kanchanaburi is open for in and out. It was in june.

Im sorry joe but youre wrong about the 3 month at immigration. I went with my girlfriend and kids and just needed birth certs and copies of her tam bian baan.

The crossing in Kanchanaburi has not allowed out/in visa exempt entries since September.

I am not wrong. You probably got a 60 day extension to visit your child not 3 months.

  1. The application must be submit at least 15 days before visa expiration and, in case of overstaying in Thailand, application could not be submitted.
  2. 1.1 Form TM.86 for the foreigner, who has Tourist and Transit Visa and applies for Visa Status Alteration and applies for non-immigrant visa; or

    1.2 Form TM.87 for the foreigner, who enters into Thailand without visa, but is allowed to stay in Thailand with a permit of stay for a period of 15 day, 30 days, 90 days and applies for non-immigrant visa.

  3. A copy of passport pages of the Applicant (for example, personal information page, last entries stamp, visa sticker and extension stamp (if any) and departure card (Form TM.6))
  4. Either one 4x6 cm photograph or one 2 inch size photograph
  5. 4.Application fee of Baht 2,000
  6. 5.1 In case of a Thai citizen, please show: A copy national ID card, a copy of house registration papers and a copy of employee’s or government officer’s ID card;

    5.2 In case of a foreigner with a permit to reside in Thailand or a person who has become a Thai naturalized citizen, please show: residency certificate, alien registration certificate, work permit, a copy of passport and house registration and a copy of documents showing Thai naturalization.

  8. In case of father is a foreigner: showing an official notarized document from a court of law certifying that child is biological offspring of the foreign father.
  9. The following evidence of income must be submitted.

    8.1 A guarantee letter from the local or overseas Embassy or Consulate, proving the monthly income of the Applicant not less than Baht 40,000* per month; or

    8.2 A guarantee letter in Thai language from the commercial bank in Thailand (Attention: Immigration Commissioner) and a copy of all entries of the applicant’s passbook showing that the applicant has a savings or fixed deposit account of not less than Baht 400,000*(Documents under 8.1and 8.2 must be issued and updated to be the same date of the Application and all documents must be in the Applicant’s name.)

Whats it extending?

Before I got it I was on a 30 day border stamp.

And if its an extension how come I can extend it?

You wrote you got 3 months at immigration. The only way to get that is to apply for a non immigrant visa.

What you had was a 30 day visa exempt entry that you then extended for 60 days to visit your child. That is not getting 3 months at immigration.

  • Kanchanaburi will not give visa exempt entry. You can only use that border if you have a valid visa.
  • The extension to visit your kids is 60 days, not 3 months.
  • On entry to the country you are given a stamp in you passport with an 'admitted until' date. When you apply for an extension of stay you are extending the 'admitted until' date.
  • It's possible to extend a 15/30 day visa exempt entry by another 30 days.
  • It's possible to extend any stay by 60 days if you are the parent of a Thai child.
  • If your friend re-enters with a 15 or 30 day visa exempt entry they can extend it at immigration for 30 days or 60 days or 30 followed by 60.

Will he be informed on exiting that he is blacklisted or persona non grata?

Hes worried about being stuck in laos

As long as he exits before the new overstay rules come in to effect (some time from March onwards) he will not be blacklisted and will have no problem re-entering.

A quick thought to consider.

Every day many people leave the country and pay overstay. I went out a couple of years ago and paid 20,000. There were at least 100 people in the queue to pay. At least 20 paid the maximum 20000. So 400,000 baht just at one border in one day.

I dont think they really want to hurry this bill through. This is another 'push' just like 15 months ago.

Im not condoning it, but nobody who wants to stay here purposly goes over.

An overstay is an overstay, done purposely or not.
