Friend, village marriage, with 4 year old Thai son.

2 years ago he tried to get a Non O based on a dependant child from Hull, UK, who flatly refused.

He is named as the father on the child's birth certificate.

Since then he has been staying on double entry TV with 30 day extensions.

With the introduction of the new METV, only the single entry TV is available to him.

He now has the required funds saved (800,000) for an extension based on retirement (he is 52) but needs an O Visa to get the extension.

What are his options?

Bangkok, yes, but he's not keen on that idea if he can get it from one of the Embassies/Consulates in Lao or Cambodia.

He can get a single entry non-o visa in Vientiane or Savannakhet based upon being the parent of a Thai. Just his child's birth certificate showing him as the father plus a copy and their house book registry would be needed.

He could also get a single entry non-o in Vientiane for being over 50 by showing his bank book with 800k baht in the account.

ubonjoe, so currently by having his name on the child's BC and the house book he will have no problem getting a SETV that last 60 days and extendable for another 30 at the local office? That will give him 90 days and he will just reset the SETV at Vientiane or Savannakhet again?

No one is discussing tourist visas,this is about obtaining a Non o visa based on children or marriage.

Your confusing things.

Obtaining a SETV is far simpler than a Non O.

I see... understood. Because I have my name in my child BC but not married to her mother and neither did I legalized my child in court or amphur.

A single entry non-o visa would allow a 90 day entry. The fee is 2000 baht and works out to be 900 baht cheaper than a single entry tourist visa to get a 90 day stay since their would be no need for the 30 day extension that costs 1900 baht.

You can also get a 60 day extension at an immigration office to visit you child. You can get almost 5 months of stay with a non-o visa and the 60 day extension.

So you mean for my case, without legalizing my daughter nor married to her mother, I can go to Vientiane to obtain Non O using just the child BC(with my name on it) and the house book(with my child name on it) for a single entry?

You can get a single entry non-o visa without a problem with just those 2 supporting documents. Same for the 60 day extension.

  • When you enter with this visa you'll be granted a 90 day permit to stay.
  • Towards the end of the 90 days you can apply for a 60 day extension (1,900 baht) at your local immigration office.
  • At the end of the 5 months you can get another single entry visa from Laos.

Long term you should legalise your parenthood. Then you can get 1 year extensions of stay or a multiple entry non 'O' visa.

If your friend was married to the mother he is automatically the legal after. If unmarried he needs to formalise himself as a legal parent either through the courts (simple with the mothers cooperation), or if the child is old enough, it can be done at the local Amphur. Mario's post should give you the information you need.

Regardless of the visa/extension situation it is in your friends, and the child's, interest that he gains parental legitimacy.

If the OP or others are looking for a non-o based on being the parent of a thai child, you can also consider going to Penang. They will issue a single or multiple entry non-o with >100k financial proof in the bank along with the birth certificate, housebook, etc. I would not recommend the OP go for tourist visa. Non-imm is more appropriate, regardless of which embassy he goes to.

My friend is now in Mukdahan waiting to cross the border first thing in the morning.

After reading the very useful link provided about legalisation, I can now explain his two options to extend his stay in Thailand.

Unfortunately he doesn't know how to turn a PC on and off, and thinks the internet is a type of ladies stocking smile.png
