Firstly, I'd like to point out i'm not here for judgement, i want advice. Feel free to rattle on about breaking the law but Im interested in putting things right for the good of my kids.

I have to sort out my overstay before this March 20th deadline comes into effect. I was planning to do it shortly after, maybe around May. Its do-able if not ideal as cash is short.

My problem is Im worried about anything on the records at immigration regarding my time spent on remand in prison here last Sept-Nov. Normally after a jail term an inmate is deported back to their home country.

The police who picked me up from prison told me to keep shtum about anything and just go to my wife and kids. They just let me go.

So is it likely that when i get to the border and check out they'll see something and ship me back to Bkk? Or let me out and not back in. (Stuck in Laos)

Or just nothing and in and out?

My gf has suggested taking my son with his thai and british passport so if anything happens i can say i have to look after him. And if i get deported hopefully he can come too to the UK as well. Ive got two boys, the younger will stay with her.

I just wish their was some way of checking.

My visa ran out while I was in jail.

Or should i just leave it. Keep saving and fly to the UK with my son as planned later in the year and take the 1 year ban?

Head doer. Ive been living here 15 years and never returned to the UK. Ive got nothing there.

I'm not sure a border run is the best idea in your circumstances - there is a higher risk of ending up in IDC and without the cash for a deportation flight you could be stuck there for a while. Additionally, I'm not sure you can re-set an overstay at a land border (I could be mistaken).

Your best bet is to take a cheap flight to a nearby country (Air-Asia - about THB 5000), pay for overstay fine (20,000 baht) and attempt to return.

How would you plan to remain in Thailand legally without overstaying again?

You have a Son in Thailand, are you also Married ? You could commence application for a Visa based on your situation with them, I'm guessing that would involve proving you have sufficient funds in an account.

You certainly need to leave before March 20th. You have been given advice in previous topics about your problems.

I suggest you contact a lawyer to sort out you legal issues. You may be prohibited from leaving the country which would be shown in immigration's database.

If i was prohibited from leaving would they detain me at Nong Khai and send me to to the IDC and then deport me?

From your previous posts it seems your legal issues have not been settled yet which means they would not deport you until that is settled. They would not let you leave the country and probably send you to IDC.

But i dont have any paperwork regarding the incident. No release forms. No anything. Almost like they coudnt be arsed and just forgot about it.

If i can get my status checked reliably on the immigration computer I might be ok.

The police boss said i didnt have to go to court. The police go for me. And dont mention anything to immigration, he said.

I dont know anything until i turn up at a checkpoint do I?

The company that I posted a link to can find out if you are allowed to leave or not through their contacts at immigration. They have done it for others.

Thanks. I have emailed them already. Would that also check if i was allowed back in or not as well?

The check will find anything that an immigration officer would see on departure or entry to the country.
