Just wondering. If someone was to cause to be published on social media in Thailand, libelous comments, eg. "the building was burnt down for the insurance money", is there anyway that person could be tracked down and prosecuted?

It might go like this:


If a third party believes he has lost business/revenue/profits because of something posted on a social media site, irrespective of what that party may or may not have done, Thai law provides an avenue for that party to pursue defamation action by approaching a court submitting documents to the court for issue of proceedings against "persons unknown". The judge could issue a court order against the social media site. If approved, that court order would require the social media site to disclose member IP address details. Once provided, the third party would go back to court to obtain a court order requiring the ISP to provide personal details (name, address etc) of the member. On receipt of that information the third party would return to court requesting/submitting an amendment to the original court papers (inserting member's details, now known) and a court order would be issued/served on the member.

Defamation is the issuance of a statement about another person or business which causes that person to suffer harm. It does not have to be false to be defamatory. Libel is when the defamatory statement is published either in a drawing, painting, cinematography, film, picture or letters made visible by any means, or any other recording instruments, recording picture or letters, or by broadcasting or spreading picture, or by propagation by any other means. Defamation is both a civil and criminal charge in Thailand.

Technically:

whether or not one can be tracked down depends on how smart he/she is.

Some are stupid enough to publish such stuff on FB with their full real name, location and more details.

You would not believe how often this happens.

So not much effort needed if he resided in Thailand.

Good luck with a case/comment done from somewhere in the world.

I would be easily tracked down currently, sitting at a fixed optical line of ToT using their provided IP address.

With or without court order the street address could be found from the log files at ToT.

And I could hardly argue it was one of the Thai family on the WiFi whistling.gif

Smart cyber-criminals / troublemakers will be much harder to track down using different levels of "camouflage".

E.g. it is still possible to "buy" user data (account names, passwords) for Amazon and other online shops or leaked credit card data.

And they have no way to track down the criminals.

Or perhaps people exposing criminality, corruption and malfeasance.

It's a two edge sword, I wonder who is the most likely victim of being cut?!

Very interesting , thanks to the mods, i say this because ive just read many comments that a boxing venue was burnt down to collect the insurance money. Not "may have" but was.
