JAS Mobile insists it has no intention from the start to give up its spectrum license

BANGKOK: -- JAS Mobile Broadband executive Pete Bodharamik insisted that the company was serious of becoming the fourth player in the telecom market and intended to bid up to a maximum of 80 billion baht during the first auction for the 900 MHz spectrum late last year.

JAS Mobile won the bid at 75,654 million baht. However, it could not come up with the first installment payment for the license fee due to unexpected problem with creditor’s bank and had the license forfeited by the National Broadcasting and Telecommunications Commission.

Testifying before NBTC’s damage assessing committee on Tuesday, Mr Pete said that the company was to be funded by Bangkok Bank and China’s Huawei company but the Bangkok Bank made last-minute change by demanding him to act as a guarantor for the license deal with NBTC.

On top of that, he said the bank also demanded that his father, Mr Adisai, to act as a guarantor as well which he disagreed with as his father was already very old.

Mr Pete, however, said he didn’t want to blame Bangkok Bank claiming that his company had been in good term with the bank for over 20 years since his father was still active in business.

He claimed that the ICPC company from China was interested to join hands with Jas Mobile Broadband to operate the 900 MHz spectrum but because of time constraint it could not it could not come up with the necessary paperworks for the NBTC within the March 21 deadline.

Asked why Jas Mobile didn’t inform the regulator its problem within the 90-day period before the first payment of installment, Mr Pete claimed that the company was not sure then that business talk with its potential partners would be successful.

He said he didn’t dare to inform the NBTC whether talks with its potential partners on March 21 would be concluded or not. He admitted that, personally, he didn’t know.

Meanwhile, Prime minister Prayut Chan-ocha said he had instructed his legal team to consider whether Section 44 could be exercised to grant the spectrum license to the second winner of the first auction, AIS. now that the license was forfeited from JAS Mobile.

He insisted that this was not a special treatment for AIS but was intended for the best interest of the state and the consumers.

One wonders if AIS might have had a little chat in Bangkok banks ear. Hefty underhanded business dealings a distinct possibility in my mind.

You shoukd be careful as you could easily have a charge of defamation brought against you by either AIS or Bangkok bank.

4th? There are already at least 4, AIS, DTAC, True and TOT.

And since when did Lung Tuu need to ask his legal team if he could use section 44? I thought he could use section 44 on whichever whim he felt.

A fine example of Thai financial planning. Buy what you can't afford first, think of the money and financing later.

What financial planning? It's called, 'using others' money to make big money' except it didn't work this time when others saw through the business tactics.

Well just goes to show that you may have been wrong about Prayuth and section 44. In this case it makes absolute sense that the next highest bidder gets the spectrum and therefore saves the country the time and expense of another auction.

TOT a player...hahahaha hahahaha hahahaha. Right!

But the deal is it can't go for less than JAS bid, which nobody else, AIS included, wanted to pay.

I'm with IMobile 3GX, an MVNO on TOT. Faster than AIS, and cheap as chips, 20 satang/MB of 3G (can by a package, but I don't use more than 1GB/month so no need) and calls at 49satang/minute. So that's a 5th player. Bought another TOT MVNO sim a year or so back as well, also excellent value and high quality service.

yup. But your TOT/I-mobile can't be used in many places because TOT squandered their 2 year lead on 3g. These auctions have the rules changed all the time. This one did as well.. It originally had a time limit.. They then had an emergency board meeting and changed the rules to highest bidder.. In reality the bids need to be equalized to a medium of the two prices.
