If a person has a foreigner staying in there home. The owner is a Thai and fails to inform Thai Immigration. What is the fine? is it a flat fee or is it a guestimate of how many days the guest has been there?

  • The number of days isn't normally a factor.

Section 77 : Whoever fails to comply with the provision of Section 38, shall be punished with a fine not exceeding 2,000 Baht. If said person is a hotel manager, he shall be punished with a fine from 2,000 Baht to 10,000 Baht.

I wonder: would those letting rooms through Airbnb be considered "hotel managers".

EDIT: also, if you fail to report multiple foreigners, does this represent multiple counts for which you could be fined separately? I think the answer is probably yes.

If you have a friend visiting.....still have to report them....???

All foreigners, with temporary permission to stay, are supposed to be reported by the owner/house-master/possessor of every place they stay at. In practice it rarely happens.

The act defines "hotel" as: "any place built for remuneration for travelers or persons who wish to look for a place to stay or rest for a period of time , in accordance with the law on the hotels."

So based on that I would say they wouldn't.

As every foreigner is supposed to be reported I guess you're right.

Let us say 'strictly speaking', if you have any foreigner staying, so friends ane even relatives would be included in that statement.

The owner may be any nationality too......

I thought they must be reported to the local police or local immigration.

Like anything else, if you are not caught it is not an issue.
