I would want to ask some information about my child's birth certificate translation and authentication. I gave birth last year to a baby boy in Thailand. I am from the Philippines and my boyfriend is from South Africa. I am currently in the Philippines. Me and my boyfriend are not able to come back to the country as of the moment. My boyfriend's mother, will be the one taking care of the processing of the travel documents of my child. She is his guardian right now in Thailand.


What should we prepare to give my mother-in-law authorization to process the papers?


Please help me on this matter as I want my son over to the Philippines as soon as possible.

Is your boyfriends mother the LEGAL 'guardian' of the child or is it an informal arrangement?

If the arrangement is informal your b/f's mother my have a problem in arranging travel documents for a baby.

I hope this is a serious post because it does not on the face of it sound like it. However let's take it slowly for starters!

1. Does your son have a Thai birth certificate?

2. Birth in Thailand does not confer Thai citizenship

3. Did you register the birth with the Phillippine Embassy in Bangkok/Did your boyfriend register the birth with the South African Embassy in Bangkok?

4. Do you have certificate(s) of registration from the embassies

5.. Who are named as the mother and father of the child on the birth certificate?

6. What was the visa status of you and your boyfriend in Thailand when the child was born?

7. What is your mother in law's visa status in Thailand today?

8. Does the child have a Phillippine or South African Passport?

It is an informal arrangement. I have contacted my embassy and they said they can help. I'm just worried the MFA might give them a hard time. Do I need some power of attorney to authorize her as the guardian?

It is an informal arrangement. I have contacted my embassy and they said they can help. I'm just worried the MFA might give them a hard time. Do I need some power of attorney to authorize her as the guardian?

I cannot provide any legal advice but I see no reason why the MFA would give anyone a hard time.

Hello. Thanks for the response. Yes I am serious.

My son has a Thai birth certificate issued by the District office of the Amphur. He isn't registered yet in neither embassies. My and my boyfriend were stated as parents of the child in the Thai birth certificate. I was on tourist visa and he had a visa from work and had work permit. My boyfriend's mother has a work permit and a visa from being employed as a teacher. My son doesn't have a passport yet since his birth isn't reported to neither embassies as stated above.

I am no expert but I very much doubt this situation can be resolved by an informal carer.

I suspect it will be necessary for you (as the child's mother) to return to Thailand before any progress can be made to resolve the problem(s).

What help did your Embassy offer ?

I very much doubt anything can be achieved from the Philippines.

Well he can't leave Thailand without a passport from either The Phillippines or South Africa. I agree with Johnatong. I can't see why the MFA should give anyone a "hard time" Indeed as you are not seeking documentation for marriage etc. I can't see what it has to do with them. I don't think Thai immigration is much interested in the status of small children. The airline is a different matter. As the child has to leave Thailand with some-one it looks like a good idea to have the authority from a parent for the accompanying adult to leave Thailand with the child notarised from one of the embassies.

The MFA have no interest in your son, he isn't Thai.

You need a passport from the Philippines or South Africa for him.

The MFA don't do translations, they certify signatures of foreign diplomatic officials.

But they do certify translations ! As they did with the translation of my English affirmation of freedom to marry which was not a signature of a foreign diplomatic official !

You are causing unnecessary confusion and possibly anxiety by posting nonsense.

So have your boyfriend's mother go to one of the agencies like Express Translation at the end of Wireless road, have them translate the birth certificate and they will organise for the translation to be certificated/stamped by the MFA. Don't know what you mean by "Required Travel Documents"(and of course I don't know what the Phillippine/S African regulations are concerning the entitlement to nationality of children born abroad!) To be Thai you must have one Thai National as a parent. Same with the UK.. Difference is born in the UK you can claim nationality. Not Thailand.

On the contrary Immigration is very interested in the status of babies and small children.

They are very aware of and wish to stop child abduction/smuggling.

I can assure you both stamps say exactly the same thing, essentially, 'This is a genuine signature',

Nowhere does it confirm the accuracy of the translation, in fact quite the opposite, 'MFA assumes no responsibility for the contents'.

The MFA just certify the signatures of foreign officials to be genuine.
