Surachai: charter court’s ruling will not affect referendum

BANGKOK: -- The Constitutional Court’s ruling due Wednesday on the second paragraph of Section 61 of the Referendum Act will not impact on the national referendum on August 7, Mr Surachai Liangboonlertchai, vice president of the National Legislative Assembly, said on Tuesday.

He noted that the charter court would rule on either of the two options – constitutional or unconstitutional. In case, second paragraph is ruled constitutional, the referendum will proceed as scheduled.

But if the ruling is unconstitutional, Mr Surachai said he believes the court will make a ruling on certain paragraph of Section 61 and not all the paragraphs or sections of the Referendum Act.

More importantly, he sections 7 and 61 which deal exclusively with the referendum will not be affected and, therefore, the referendum will not be affected whatever the ruling of the court.

The NLA vice president ruled out a suggestion that Section 44 of the interim charter should be invoked to ensure peace and order during the referendum, saying that it is not necessary as there are other laws which should be enough to cope with untoward incidents during the referendum.

He insisted that free expressions pertaining to the draft charter and the referendum are permissible unless the views expressed are fabricated, distorted or are intended to incite unrest.

Surachai is quite correct in this assumption , a court ruling won't affect the referendum , what Surachai has conveniently forgot to mention that no one can be charged under 4 & 2 if these parts of 61 are found unconstitutional, so one could imagine that the Junta will invoke section 44 , regardless of Surachai's opinion , to keep everyone's mouth shut about the referendum and any dissent will be dealt with through that course of action, as this will instill more fear into the population than common law, and what are they hiding , the fact that Thailand will be under a Junta rule for a very long time , and it is very similar constitution which was challenged by students in 1992 ..........................................................coffee1.gif
