Work by Thai Entering on Foreign Passport and O Visa

Hello to All with special mention on this forum topic to Ubanjoe. What is the ruling for a born and bred Thai now entering Thailand on a NON-THAI passport with a Thai O visa, and extensions, with regards work? Would they now have to report to immigration every 90 days as is the norm for a foreigner? And would they also have to abide by the no work without work permit law? Or are they exempt because they were Thai at birth?

No issues here to report; the question just arose in conversation.

If a Thai enters on a foreign passport the same immigration rules apply to them as any foreigner. That also includes overstaying.

For working it would be different since they would just be showing their Thai ID card and house book to the employer and would be hired as a Thai.

Ubonjoe, So basically, if they are exempt for work purposes, then surely they can also overstay and obtain a Thai passport for exiting the Country as and when they want, n`est pas? If stopped by police while overstaying, would they need only to produce their Thai ID for all to be OK? There appears to be a get out clause for Thais entering the Kingdom on a foreign passport.

I can see no reason for entering on a foreign passport if they are Thai. If they had a problem getting a Thai passport they could get a certificate of identity at a Thai embassy or consulate by showing their Thai birth certificate that would allow them to enter the country as a Thai.

If entering on a foreign passport and then trying to leave on a Thai passport it is possible that their entry would be found by a name and date of birth search of immigration's records. Best to just fly out and back to swap passports.
