Looking for the usual expert advice on similar situations but with certainly different outcomes.

 

My wife and I are both US citizens. She is in Thailand on a retirement extension that will expire on January 25, 2017. because of her usual travel schedule and the hassles at Chiang Mai immigration, she plans to let the retirement extension expire. She'll eventually get a new one-year Non-Imm O visa in the US. She will be entering Thailand on Oct 12. Her 90 days will be up on Jan 9. If she goes to Mai Sai/Tachilek on Jan 9, I assume she will get a stamp that only gives her another 16 days, until January 25. Is that correct? If she got stamped in for 90 days, that would solve all of her problems. Is it possible she could get 30 days on a visa exempt entry, and then later extend that for another 30 days?

 

I am on a one-year Non-Imm O visa. My last day to enter is Oct 27. I will be entering on Oct 25. That will give me 90 days until Jan 22, 2017. Under current rules/laws will I be able to do an out-in at Mai Sai/Tachilek just before Jan 22, and get a 30 day visa exempt entry? (I would be leaving with a visa, coming back without.) If so, could I then extend that for 30 days? That would get me to mid-March when I plan on leaving Thailand for several weeks. Between April and July I'll probably only be in Thailand for about 3 weeks.

If she has a Multi Entry Non Imm O Visa she would get 90 days on entry.

What makes you think 16 days?

If she has a one year extension of stay she does not need to leave the country every 90 day she just does reports to immigration. I see not reason for her to do a border crossing until the until the 27th of January.  Also Mae Sai doe not allow crossings unless you have valid Thai visa for re-entry.

I think she should reconsider letting her extension run out. The honorary consulates in the states can no longer do multiple entry visas. Only the embassy and the 3 official consulates can do them and none of them will do a non-o visa for retirement. She could only apply for a OA visa.

That's what I was worried about for my situation. Even though I would be leaving Mai Sai with a visa since it would expire as soon as they stamped me out, they wouldn't let me back in. In the past, they let you do one out-in. If that situation doesn't change in the next 3 months, I'll just go somewhere where I can get a single entry tourist visa.

 

As for my wife, the New York Consulate is a very easy trip for us. It is much, much easier to get a one-year visa than to go thru the hassles at CM Immigration. Not to mention cheaper. We know she doesn't have to leave the country every 90 days. We're just trying to figure out how she can stay beyond Jan 9 or 25 without renewing her retirement extension. Given the circumstances in the original post, would she get an additional 90 days until approx April 8 if she did the 90 day report without renewing her retirement extension (expires jan 25)? Or, if she chose to leave the country (Mai Sai or anywhere else), would that give her 90 days from the day she re-entered (as long as she re-entered before jan 25)?

The answer in both scenarios is No. Your wife's extension expires, you say, on 21 Jan 2017 --  and no 90 day extension beyond that date is possible.  If the lady wishes to stay longer in Thailand, without renewing her extension, she should obtain a single entry tourist visa or "O" visa from a nearby country. To get the "O" visa she will have to demonstrate 800K Bht in a Thai bank or an income of 65/K Bht/monthly income.

If you leave and re-enter on or before the enter before date on your visa you will get another 90 day entry from your visa.

I suggest you contact the consulate in New York about the multiple entry non-o visa. I am certain they will only do a OA visa.

After her extension expires she would have to get a single entry non-o or a tourist visa to stay until April. Or she could go to the Chiang Khong crossing to get a 30 day visa exempt entry that can be extended for 30 day at immigration.

There was no question about my getting 90 days when I enter a few days before my one year is up, effectively giving me 15 months on a one year visa. I've done that several times.

 

My wife beat us to it though. She was sure that none of this would work and that there was no way to stay beyond january 25 without further extending her retirement extension in CM. That was a horrendous experience last year and with this year's necessity of filing TM30's, she said there was no way she was going to do that. She went to the Thai Consulate in NY yesterday to get a Non-Imm O visa. initially they didn't want to issue that, but only because they thought she should just renew her retirement extension. she explained the problems at CM Immigration and they agreed. She picked it up today (one-year, multiple entry Non-Imm O visa, the same as I always get).
