divorce

Featured Replies

I am a Canadian and have been married to a Thai lady in Thailand for just over 3 years-the marriage is registered in the amphoe. She has never been to Canada and the marriage is not registered there. She is a very nice lady, but I have decided to move back to Canada and want to get divorced. We have no real problems-Thailand just isn't for me. We have a good house, furniture and car in Isan, but no children together-she has two from a previous marriage to a Thai.  She is welcome to all our property, car, etc. in Thailand as well as money in the bank of 400,000 Baht. My questions are: 1. If I go to Canada now, can I hire someone here in Thailand to do the paperwork for the divorce-she is okay with it and is not opposing it?  2.  Can any assets I have in Canada be attacked from Thailand or by Thai law?  .Thanks

If you want nothing from the marriage and she is in agreement to the divorce then it would take about ten minutes to get divorced in a district office. Far better to get it done and out of the way before you go.

And no there is no way anyone can lay claim on your assets outside of Thailand, period.

One other thing, you asked about can someone else sort your divorce for you, well the answer is yes, you have to give your lawyer the power of attorney and it has to be done through the courts, so you see it is far better to both go to the amphur and spend ten minutes there and get it out of the way.
