Hi everybody.

 

If anyone has some Informationon starting a small Restaurant while in possesion of a Non O Visa based on marriage, please let me know.

 

I want to live and get married to my Thai woman friend and start a small Restaurant in Ubon  to have bit more income then my Retirement. And i like to do something there and as cooking is my passion, so i think about opening one or two small Restaurants. 

Is that possible or not. If yes whats the pros and cons and can i get a work permit if i own a Restaurant ?  And what role my wife will play there ?

I read somewhere  that all business i will start is automatically on name of my wife. Is that correct?

And any other  information on that subject ( Married, non O Visa, Work permit, Own small Retaurant ) will be appreciated.

  • You can start/own a business with any visa, however, you cant do any work for the business without a work permit.
  • You can only get a work permit if you are employed by a company. You and your wife could create a new company that could employ you.
  • You can't have a work permit as the owner and would probably find it hard to get a work permit as a cook/chef. You would probably need to be employed in some managerial position.

you only can do work that a Thai can not do and that is allowed by the thai labor office to do

 

if you are marrier you need to deposit 1 million for the company if not then it is 2 million

 

you have to employ full time 4 thai staff per foreinger that is granted to have a work permit as wll to pay you own salary

 

if you get a work permit you are only allowed to to work at the place in the workpermit as well ONLY to do the job describt n the work pernit

 

as shareholder of the company you only can own 49% of the shares as a foreinger the rest are for 2 or 4 other thai.

 

I am afraid the work you tell you want to do you are not allowed to do as foreinger. especially there are so many thai woman who can cook western kitchen and do qualify forthe job. (For this you can thank  all the others who have Thai wife and let them live abroad, most who came back need work too for some abovious reasons.)

 

and haning around in the company of your wife and do small things we havce seen on this forum many time that htat causes lots of problems too wth the labor office or immigration or police.

 

I am afraid your wife can havean good resaurant and you are the investor.

sitting home and walk around waitngin till she has her off time.

 

you have you pension , and get extra money form the investment you made  per month or quater or half year all very plausable.

 

as well yout wife has income and generates money.

She herself can open whatever she wants based on her name only. But as you want a work permit you need to have a company. Company consisting on 2 Thais owning 51% and you 49%. Since the shares have different value you can still be in charge but i urge you to search the forum for more info about that. Forget about yourself is going to work as a cook. But you can still be in the kitchen instruct the workers what to do. That i know from my days at several markets in Pattaya, where many farangs have shops.

Thai labour laws are enforced now a days and the old days are gone.

When you instruct staff you do that as a superior to the worker and are doing work yourself. For this you need a work permit

If you have no work permit and they catch you, then you can spend time in jail and pay the fine as well become blacklisted. Meaning you are not allowed to come in Thailand any more for short or long time.

Yes that is correct. With a work permit . As kitchen manager he should be allowed to supervise and tell people what to do but not work himself. I were in Thailand 3 months ago when the new rules started in Pattaya, All markets got visits from immigration and we all( farang owners with Thai wifes) were told that we cannot work inside shop but  could be inside shop, but not alone. If we were alone then that could be taken as we worked. We could tell wife what to do but not sell or talk to any customer. Not even hand the wife anything inside the shop. Now that is in Pattaya and i dont know if this is same everywhere. The market owners told us that it is no problem if we want to work because they always know beforehand when the police comes for inspection since the markets are owned by some well connected man. I understand you are reciting the law but im only telling you what we got to know.

i am a 9 year business owner in thailand. recently put in a manager so would not have to deal with the associated problems. we are a high turnover business and there is a lot of advice i would like to give you which has all be said before. best piece of advice i have seen regarding businesses is dont invest anything you cant walk away from and dont rely on the business income. was years before we started to just break even. i see many guys start a business and they wont walk away from it because of pride. if your not covering the rent in 2 years pack up if you can stay in business that long. for the amount of work you will be able to do you cant justify a work permit. it takes many many meals to cover work permit expenses. i would say it is minimum 100 000thb. i pay quite a bit more because i use a very expensive accountant who does the accounting and work permit. since i started using her services and paying a police fee we have almost been problem free. have still had a few serious theft issues mostly from staff but also from customers.

if i were you i would walk around the area and ask if any of the current restaurants are for sale. if many of them are then its probably not going to work, especially if you dont have a lot of experience.

wow it seems i have to better do nothing and just live from my pension and  with my savings on  1 or 2 banks get a incretible 1,5% interest and be happy and enjoy Life. Anyway my wife has as well a good job in Makro and family is small only 3 persons with me 4.

Can anybody tell me if i can live well with 45.000,- TBH a/month in Isan ? Plus my wifes +/- 10.000,- TBH a/month. Is that enough to live a good live there ?

45-55K is more than enough to live on anywhere in Thailand as long as you're not in the bar every night.

Haha yes thats shure but i am not a hang out in Bars only occasional i like a good belgian Beer or a Guiness. Thanks for reply. make me feel better allready.

At the current time, 45,000 + 10,000 baht a month is plenty to live comfortably but simply in Isaan, and still add to your savings (which I would recommend as you may need a higher income in the future).
