overstaying rules under 2 years old

Featured Replies

Hello,

My wife and I live in Thailand for education and we have ED Visa from Thai Language School. We have a baby who is 1 years old and she has tourist visa. She has one month to extend tourist visa from immigration office.

My question is that, can she overstay without any problem? What is the latest information about kids overstaying that under 2 years old?

There are no penalties for under-18s who overstay. However she will get an overstay stamp in her passport. I would extend her stay or get her added to yours as a dependent.

She should really have the correct visa / immigration status but there is no fine for 15 and under.

No problem to be expected with immigration on arrival in Thailand.

Problem possible at check-in at departure airport if child and parent have no valid visa or re-entry permit and no confirmed return flight within period of visa-exempt permission to stay, if any, for your nationality.

The single biggest problem in communication is the illusion that it has taken place

You have to go to a nearby embassy or consulate to get them a non-o visa as your dependent for your child to get an extension.

There should be no problem for a child entering the country with a overstay stamp.
