Mum is Thai and Thai resident, our son was born in the UK and has a Uk passport. ( 4 months old )
i got him a 90 day visa befor they went , its now approaching 60 days and my wife's making plans to take him to immigration for the +30 days bit .
BUT shes been told that her son dose not need a visa because shes Thai and hes attached to her ...or something like that .( village gossip)

dose any one know if this is true .

There are two choices available:

1. Your son overstays. Upon his departure from Thailand his overstay may be recorded in the passport but he will not have to pay a fine because a person of that age is not punishable for his transgressions.

2. Your son applies for an extension of stay. This extension can even be for one year if he has documentary evidence that his mother is a Thai national.

I understand the fine is waived for minors.  However does the same apply to the banning period also?  If a child overstays for a year or more will they be subject to the same banning procedures as adults?

If the woman is Thai her son is Thai and he is entitled to a Thai passport for that reason

Now there are requirements she needs to show to verify that she was born in Thailand and is  a Thai citizen.

It would be wise to get her son a Thai passport as then he would not need a visa to enter Thailand.

Where the son was born does not matter, if the mother can prove her Thai citizenship her son is also Thai.

He is then a dual citizen if his father is from the U.K.

Have the mother contact the Thai embessy to find out what she needs to show

Children under 18 years old are exempt from being banned from the country.

just go overstay this trip, and get the poor lad a Thai passport, i have read its easier to get the first one in the UK, i could be wrong but rarely.

Have you registered your son's birth at the embassy in London? That is the only place where his birth can be registered and it will need to be done before he is able to get a passport.

As said your son can get a one year extension based upon being returning Thai national. His UK birth certificate showing his mother is a Thai and her ID card and copies of her house book registry.

thanks everyone for your input

no ,  we didn't have time to go to London and register the birth. i was told on here it cant be done buy post so we have no Thai birth certificate ...so no passport this time .

 

dose the one year extension cost much....or is it free 
can she get this at Udonthani immigration , she has all the paper work
