Refused a new teacher Non B URGENT HELP

Hello all. Having a bit of a nightmare here.

 

I left my old school. They refused to hand back my work permit or give me a termination letter so I left their visa by doing a border run to cambodia and entering on a new tourist Visa.

 

I did break my contract and did leave the company on bad terms but believe me this employer was treating staff horrendously. For obvious reasons I will not name this company nor try to expose them but if you google tefl blacklist they come up very high on the list multiple times so it was for good reasons I had to leave.

 

Anyways cut to the chase; I have joined new school and I'm really enjoying it. Today I was sent to Chonburi Immigration (In Jomtien, Pattaya) with all the correct paperwork to apply for my new Non B. The woman at immigration refused because I do not have a stamp in my passport to confirm my old extension of stay (although she called it business visa) had been cancelled. My old school will not give me a letter of resignation nor will give me my work permit back so I am left in a situation where I have 30 days (the remainder of my tourist visa) to some how figure this out.

 

Does anyone know how I can get this visa stamped as finished without my original work permit / letter from my previous employer.

Can I further add that the website to print off a "work permit cancellation" form is currently down; so if anyone could upload a PDF version if needed that would be great.

My new school are now stating until i'm fully off that visa they will not allow me to work to defend their back. Will the department of labour be able to help in any way?

The Labor Ministry would not be able to do anything about an issue with immigration.

You could go to the local work permit office to find out if your work permit has been been canceled and have it cancelled if it has not been done.

So essentially without letter of dismissal from the old school there isn't much I can do?

Immigration might cancel your extension with proof your work permit has been canceled.

I think your best option is to go to a nearby embassy or consulate and apply for a non-b visa so that you can get a work permit issued. Then apply for a new extension of stay.

Wow didnt even realise you needed a stamp in the passport to cancel the EOS! I though you could just get a new visa and that was that.

If you are married you could always got savannaket get a 12 month NON- O with just a signed copy of thai wife blue book and signed copy of ID card then once you got that you can just apply for a work permit.

You say that the school refused to give you back your work permit.Many schools keep the WP in a safe,in case of a visit fro immigration,but they allow you to make copies of it.Its essential that you do that,in case you are stopped by immigration or the police.

If you paid for the WP then i cant see how or why they would keep it.

There are schools that do treat their staff like slaves and 1 in particular is well known for its behaviour in that direction. The WP can be cancelled by the school at any time and they do it out of spite if you get a better paying job.I had to go to Laos for my non B.Sorry i cant be of more help,but theres not a lot you can do here if you fall out with these people.

Some of the posts in this thread seem to refer to a visa or extension or work permit as if they were the same thing, which is a little confusing.

The extension is not longer valid after leaving and re-enter the country.

Some immigration offices are insisting the extension stamp be canceled before issuing a new extension even though it is no longer valid. Or as in the case applying for a conversion to a non immigrant visa. 

The proper procedure is to cancel the extension and work permit before leaving the country. I think they are punishing people for not doing it correct way by insisting they get a letter from the previous employer to have it canceled at the office that issued the extension.

This is a result from many people just walking away from the their job without giving notice.

Contact The Ministry of Labor to go to the school with you to retrieve your WP, i;m sure they must be violating some sort of rule by refusing to give it to you, despite what people say the MoL do do their jobs

 

Not sure if it will help you get a new Non B but it is a start

But that was part of my point. A valid visa would not be cancelled ... assuming, for example, that someone had a still valid Multi-entry visa, it would remain usable until its expiration date. If you originally entered on a single-entry visa, it would have been stamped "used," and therefore cancelled for further use, as soon as you entered the country.

 

An extension would become (as Ubonjoe said) invalid, but not technically cancelled.

 

 Visas and extensions of stay are two different things. Visas, for the most part, are issued by an embassy or consulate under the Ministry of Foreign Affairs. Extensions of stay and permissions to stay are issued (and may be cancelled or renewed/extended) by immigrations.

If your "former" refuses to give a termination letter or refuses to cancel your work permit, that suggests the employer still considers you an employee. I'd get a solicitor to draft a letter on your behalf seeking wages due in the interim.

If you read his opening post, he admits to breaking his contract and left on bad terms. Perhaps the school could well counter his claim and look for compensation from him for the cost of obtaining an emergency supply teacher?

Did you resign with a letter to personnel?   The schools will do what they want and can, depends...

 

Good luck with the process.  If they paid for your work permit, then it is their hands of care.

Documents for new Non-B> book train to Hat Yai> minivan to Penang> get new Non B, 

job done.
