New Company and Work Permit

Hi

Just finished registering a New company and intend to  cancel my existing work permit from old employer and apply for new one. However the labour office is saying need to show 4 Thai employee salary/social for 3 months before can apply for work permit. So is this normally the case as I cant then work in new company for at least 3 months.

 

I will in future to be the MD as well as general manager, as MD I don't need a work permit to sign documents?

Technically the 4 Thai employees only applies to extension of stay based on work.

Some rouge labour offices want the immigration policy however.

 

As for signing documents, you can only do that in the role as owner.

 

If you are in good terms with your old employer you could add the new company and location to your existing WP.

so it seems the main labour office in Bangkok needs the 4 on the books for 3 months before applying for wp. (catch 22 it seems) as you need a to apply for a wp and get a receipt and then apply for non b normally outside the country.

 

With regard being MD. I meant if I were just MD I don't need to have a work permit (just signing docs)

 

but if I were md and general manager I would of course need a wp.

just get your accountant to pay the social on your thai employees in a rears and you should be ok. have you had a company before? just a warning, it is getting harder and harder every year to keep re newing work permits.

In what way is it getting harder? I haven't seen any changes that make it more difficult (in any real sense of the word) over the last 10 years on my current WP; I just got my annual stamp in the WP and extension of stay last month.

 

Realizing labour offices are slightly different in their requirements, I would be interested in what was demanded from you that makes the process harder.

my business has been running 9 years. each year they get more aggressive questioning my manager and thai staff. last year the sent round 3 lots of people to photograph my business. this was after i sent in several lots of photos. this is the chonburi labor office. may be different for the bangkok labor office. i have a good accountant with contacts in immigration who keeps things going for now.

As user "williamgeorgeallen" says, it may well be different from district to district, what Labor Office and Immigration want and do. Your accountant should be able to inform you about what you shall expect in your area concerning Work Permit.

 

What I normally hear is needed for 1 alien Work Permit, is a registered shareholder capital of minimum 2 million baht, 4 Thai employee, and sometimes also first Annual Statement. There might be exceptions for certain business.

 

To my knowledge, an owner and director (i.e. board member) can do limited signing for the company, like signing the Annual Statement and similar documents, whilst anything that have to do with daily operations require a Work Permit – there has been few articles in the news section about this, so years back.

 

Managing Director (or CEO) sounds in my ears like a person that has to do with the daily managing of the company, and reporting to the Board-of-Directors.
