Hello,

I recently started work at a company in Thailand that has a relationship with the Board Of Investment which seems to allow them to get visas and work permits in a different way to the norm. Unfortunately it is stricter than the norm and they rejected my application on the grounds of not having a valid letter of work reference showing min. 5 years work experience that a Thai person couldn't have. I've been advised to go down the route of setting up a company and getting a work permit that way but then contract out to them.

 

I got a 3 month Non-Immigrant B visa with their paperwork which has about a month and a half left. I hear that was the difficult part.

 

Do I still need to set up a company? Someone said you only need that to get that 3 month non-immigrant b visa, not for the work permit, and if I get the work permit I can use that to get the 1 year visa. I don't see how I would get that visa. Would I need to do another visa run? Not need paperwork regarding the company setup?

 

If I do need a company, can I just add myself to the company of a similarly contracted colleague? Want to know if I can save on the time and money involved in having my own company.

 

If I do have to set up a company I understand that there are one stop shop type services here in Samui that can take care of everything but cost a lot of money and take a lot of time. Any recommended services of this sort? Things to watch out for?

You can not work without a valid work permit.

If you set up a company the company must have 2 million baht registered capital and employ four Thais per foreigner to get the work permit.

 

There are companies on Samui that will pay someone at labour office to go around the rules.

There's also people that drive without helmets on Samui.

Thx for the responses. Anyone have an answer to the question of whether I would need to get a different Non b visa based on the new company i set up? Or can i extend my current one to a one year one once i have my work permit?
