Dear forum members,

 

i'd like to apologise for bothering you, following questions or similar ones might have been asked a million times before, but in the jumble of posts across other threads i got more confused than enlightened. So my situation and questions:

 

- age: 39

- nationality: German

- married to Thai spouse since 04/2016

- we have a son together, born in Thailand, aged 10 months, his nationalities: Thai & German

- i am staying on a Non-O Visa, which i applied for in Savannaketh and which will expire on 29.05.2017

 

Questions:

 

1.) Do i have to go abroad to apply for a new Non-O visa at a Thai consulate or embassy, or is there a possibility to "renew" the existing Non-O Visa at the local Thai Immigration Bureau, e.g. at Chonburi Immigration in Soi 5, Jomtien Beach?

1.1) If yes, which requirements are to comply with?

 

2.) Until today i always left the country after each 90 days, because i did not have enough money on my bank account. Is there a way to avoid leaving the country after each 90 days?

2.1) If yes, what are the ways and which requirements are to comply with?

1. You cannot renew your visa here in the country.

    You could apply for a one year extension of stay based upon marriage at a immigration office. You would need to have 400k baht in    a Thai bank for 2 months on     the date your apply for the extension or proof of 40k baht income. You could apply for the extension      during the last 30 days of any of the 90 day entries from your visa. List of required documents and etc is here:  Marriage Extension Requirements.pdf

 With the extension you would only need to do 90 day reports to immigration.

2. You can apply for a 60 day extension to visit your wife for any of the 90 day entries from your visa without financial proof. Your wife will need to be with you                when you apply for it.

    You will need your marriage certificate plus a copy, copies of your wife's house book registry and ID card.

You can would not need to apply for a new visa until November if you leave and re-enter the country on or before the enter before date on your visa (29 May?) to get a new 90 day entry. Then get the 60 day extension of it.

thank you ever so much for your kind reply and for your efforts. If your time permits another answer i would like to kindly ask you to verify if i understood right:

 

to point 2 (i attached a scan of my Non-O Visa to this post):

2.1 i'd have to leave before 29.05.2017

2.2 then come back with 90 days stay permit

2.3 before the 90 days are over i can apply for a 60 days extension (how long before would i have to file the application?)

2.4 and then after 90+60 days i'd have to go abroad and apply for a new Visa or go to a local Immigration Bureau and apply for Marriage Extension, given that i can meet the "Marriage Extension Requirements"

 

Could you please also comment on this perspective to my situation:

3.) supposed that one day my wife and i should not longer be married with each other any more - she is unhappy and convinced to be better off with an older farang with more spending money and more leisure time -, would the fact that my son has Thai citizenship and is living in Thailand be a reason for granting a Non-O Visa to me, his father. And, would it make a difference if he'd be living with me, or living with his mother, or if i'd have 100%, 50% or 0% custody?

You could get a single or multiple entry non-o visa based upon being the parent of a Thai. Your child living with you or not would make no difference.

You also would be eligible to get the 60 day extensions.

You could also apply for a one extension of stay at immigration based upon being the parent of a Thai. At least joint custody of your child from a divorce would be needed when you applied for the extension,
