Non-immigrant b visa - criminal background check?

Featured Replies

Applying for a non-immigrant b visa (to teach) requires a criminal state level background check. Will a minor in possession of alcohol arrest (from when I was 18 years old) impede me from getting the visa? The charge is dismissed.

Never had to show, nor get one from home country.

I had to get one from Thai police in Bangkok in 2012 for non-B and haven't had to get another after that.

Immigration is fickle at best and they change rules and regulations as they please.

Good luck.

Where are you applying for the non-b visa?

I would guess the minor offense when you were young you will not show up on a criminal background check.

If the charge is dismissed, it will mean that it never were any sentence given to it.
Depending on how they look at the dismissal as with or without prejudice it will show in different ways.
A dismissal is also very likely on your register. That will say on the BOP of CORI (US named part of register that have other names in many other countries).

As Ubon Joe replied it will have to do with where you are applying, and in what country.

The mind boggles thinking that someone charged with possession of alcohol at age 18 could possibly be branded a criminal and banned from entering Thailand.

Usually  and I mean 99 per cent of the time  never discussed. Do not volunteer any information that is not required.

This has nothing to do with being banned from entering Thailand. He is trying to get a visa to come in as a teacher...he can come in as a tourist without any issues.

Rest assured there is not chance the charge will show up on your background check..   I've not seen any of my adult indiscretions show up on my background checks done ever other year (Work visa renewals but not for Thailand)

I will not be able to say what is going to happen or if it is a problem in reality. I only know how the system usually works.
Is this many years ago, it might be overlooked, just because of that was dismissed and never any sentence given.
If it´s newer than 8-10 years it might be a bigger issue. As I say, though, I will not be able to have any clues about how they will look at it. We can look at it in the ways of Thai eyes. In that point of view a minor in possession of alcohol or in a drunken state, usually only will raise a message to the parents with a warning. Niether here I will be able to tell you how they will look at it regarding a foreigner applying for a visa.

I had a run in with the law in Australia for possessing alcohol as a minor (a month shy of my 18th birthday), and also one for supplying alcohol to a minor (I was 18, my GF was 17 and again a month shy of 18)

Never had in issue getting a WP in Thailand

Good to know! Did you have to submit a criminal background check/did that charge appear on the check? Thanks.

For single entry non-b visa there are several options for where you can apply for the visa.

There is the embassy in DC and the 3 official consulates in New York, Chicago and Los Angeles. Or one of the honorary consulates can be flexible in their requirements. See: http://thaiembdc.org/royal-thai-honorary-consulates-general-in-the-u-s/
