Phuket's Rawai Mayor waiting on ‘express instructions’ from court for Eva Beach

PHUKET: -- Rawai Mayor Aroon Solos has told The Phuket News that he will not take any action against the Eva Beach condo project until he receives express instructions from the court.

 

The news follows the regional Administrative Court in Nakhon Sri Thammarat handing down a verdict last Tuesday (Aug 1) in which it found Rawai Municipality guilty of neglecting to perform its duties in upholding building and environmental regulations and illegally issuing building permits specifically in relation to the construction of the Eva Beach project. 

 

“I am waiting for the judgement details to be sent this week. Only then will I order public works officials to issue an order for the offending structures to be removed, which will then be handed to Property Phuket Eva Group Co Ltd,” Mayor Aroon told The Phuket News.

The procedure to receive the instructions from the court, will likely take months if it ever does get to him that is.....my guess is that construction will continue unabated.

Funny how amidst all these legal proceedings, we never hear of any investigation into the officials at the Phuket Land Office for corruption as to the issuance of building permits and deeds which obviously were the result of the passing of brown envelopes.

Bingo ZR.  I know people with property around this Eva project who have been objecting for years. Local envelopes long since passed, thus .........done deal. To reverse? Hmmmmmmm..........maybe more envelopes and all under the carpet (again).

It appears the condos are basically completed and they look like high end units.

This is going to get UGLY is a hurry. I wonder who owns the individual units.

Big losses, big legal fees.

as well in this instance- but very powerful forces are at work here, and the power of their money and influence speaks volumes, unfortunately much more loudly than mere court rulings- witness this individual's stubborness and inaction, it is obvious that he is no stranger to brown envelopes :saai:

So the Administrative Court of Thailand issues and publicly posts a ruling, after a 6 year investigation, and then the court is required to disseminate said ruling and to issue exact instruction to all parties involved ....So that is who exactly, the Mayor, the Tesseban, the Wrecking Ball operator....Truck Drivers?

 

What I read was this (Thai to English sorta of translates like so)..... . . Therefore, the “Tesseban” has the duty to issue the suspension of relevant actions and to prohibit anyone from using or entering any part of the building, and issue an order that the owner of the building to correct such fault or to remove the building depending on the case in order to observe the stipulations under Article 40, 41, or 42 of the Building Control Act 1979 (B.E. 2522) and other relevant law. However, as it appears that the “Tesseban” did not act on their duty to enforce the owner of the building to correct their building to observe the law. In this case, it can be held by the context and action of the first accused that the first accused had indeed neglect their duty by law in relevant to Building Control Act and other law under Article 9 paragraph 1 (2) of the Act on Establishment of Administrative Court and Administrative Court Procedure, B.E. 2542 (1999).
 The court is of the decision that the “Tesseban” shall observe their duty under Building Control Act 1979 (B.E. 2522) and other relevant laws within 90 days from the last judgment . . .

 

Lets get on with this....like 6 years wasn't long enough to wait for an illegal development to be knocked down.

6 years is not long given the defendent has the money and clout to drag it out. AFAIK after 10 years there is no case.

The old ' please Mr Developer it's nothing to do with me so don't blame me. I am only obeying orders' line coming out.

 

No wonder he looks so worried in the photo- a source of income drying up!
