If the company is established, you do not need to leave Thailand, to change your visa.

6. Employment contract (Labor Dept.)

7. A letter to guarantee to certify commercial registration

8. Company registration certificate.

9. VAT registration certificate and the lists of company Board of Directors.

10. The latest financial statement. (Balance sheets; Profit and loss statement)

11. Company income tax or trading tax returns.

12. Documents evidence of education; job experience of Alien. The diploma must be notarized by the Embassy and certified by the Ministry of Foreign Affairs of the translation into Thai and the copy of the diploma.

13. Withholding tax records

If you apply outside Thailand for the Non- B, some Embassies will require a WP-3 and the employer company doc's signed and stamped with invite letter.( Penang, Laos, Cambodia)

Others will not require a WP-3 ( Singapore, KL, Perth, Brisbane, etc) just the employer company doc's signed and stamped with invite letter.

If it looks like all this is going to take too long, just pop over the border (Cambodia, Malaysia, Laos) for a day, and get another 30-day tourist visa (if you haven't gone over your 90 day limit). That'll give you some more days to get your documents in order, and you can relax a tad bit more.

Couple hours to get the 90 day extension.

and do you think its possible to get it done before the weekend?!

If you have all the paperwork

In most cases, yes. ( depends on your nationality for the moving goalposts.) Remember this is for the change of visa. No other time, would this be required.

witholding tax records - is this evidence of the tax i paid whilst in my last job?

Yes if it was in Thailand.

Can I just re-affirm this? In order to make a change from a tourist visa to a Non-immigrant B visa, it is not necessary to leave Thailand and have the Non-immigrant B granted at a consulate outside Thailand? If this is true, has this always been the case or is a new policy? I have recently been told that I must leave Thailand to get my Non-immigrant B.

quick update . . . .

I went to the immagration office (3rd floor) and submitted all of my papers . . .and they asked my why my company wasnt there with me (good question!), and told me that I needed 21 days left on my tourist visa, as this is how long the application process takes - so they didn't accept my application.

Isn't this rule a bit stupid considering the new laws?! if my Non-imm application isnt successful I've wasted nearly a whole month waiting to find out if I get my visa or not!

anyway . . .I went to cambodia on sunday to get my new tourist visa and will be applying again tomorrow - hopefully with better success!

anybody got any tips on what exactly they expect presentation wise (of papers) and what a BOI letter is?! I will be the first farrang to work at this company so they are a bit clueless on what exaxtly needs to be done, so I'm just trying to push things along!

what a BOI letter is?!

If they don't know. You don't need it, as your company needs to have been granted a promotion from the Board of Investment to get the letter.

At last!!! They have accepted my application . . .only have to wait till the 8th to find out whether Ive been granted it or not . . .

If I havent been granted it I guess i'll have to be heading back to the UK cos of these crappy tourist visa limitations!!
