If changing from 800k baht deposit method to monthly transfers, you'll need 12 month of minimum 65k baht transferred each month. Using 800k baht deposit method, you need 800k baht ion your deposit bank account two month before applying for extension of stay and three month after granted extension of stay. Thereafter the deposit can be lowered to not less than 400k baht, but must be topped up again to 800k baht two month before next application for extension of stay. If the combination method is accepted by your local immigration office, the bank deposit shall be of at least 400k baht, while the remaining amount can be monthly transfers.

You can obtain a non-immigrant O-type visa either from Belgium, which will give 90 days of stay in Thailand, or you can enter visa exempt with a 30 days stay and after two weeks apply for changing from visa exempt to non-immigrant O-visa, either based on marriage to a Thai or based on retirement, if you are 50 years or older. When apply for non immigrant O-visa in Thailand you need to have fund deposited in a Thai bank account, either 400,000 baht for marriage or 800,000 baht for retirement. If you apply for the visa from your home country, you will need to show financial status, but don't need a physical bank deposit in Thailand. However, you might need it later. When entered on a non-immigrant O-visa you can get your stay extended for one year. That will be a repeating annual procedure. If you wish to start a business in Thailand, you cannot use extension of stay based on retirement, but using marriage to a Thai, you are eligible for a work permit. Be aware of, that you need a Thai partner – who can be your wife – a minimum business capital, and 2-4 Thai employees for one work permit for a foreigner. Your annual extension of stay can be changed between retirement and marriage upon renewal, but the procedures are little different. In my opinion, retirement is the easy procedure – but requires a financial status of 800,000 baht either as income or in bank deposit – while extension of stay based on marriage requires more paperwork, but only 400,000 baht in financial status. You can be partner or shareholder in a business – including a board member director – without a work permit, but then you cannot do physical work, apart from board meetings and signing high level documents.

When you stay more than 180 days within a calendar year (= tax year), you income taxable in Thailand. When you stay less than 180 days in your home country, you might be partially taxable or limited taxable there. Your country probably has a Double Taxation Agreement (DTA) with Thailand, so you are not double taxed of your income. A legal trick is to live from savings when staying in Thailand. Money earned abroad is income taxable in Thailand when transferred into Thailand, but only if it's during the same calendar year as they are earned. Savings are not income taxable in Thailand. The trick is to keep foreign taxable income abroad until the following calendar year – or any later year – before they are transferred into Thailand, as they by then are magically transformed into savings...????

Same sex marriage and marriage visa, will it be possible?
khunPer replied to JoseThailand's topic in ASEAN NOW Community Pub
Move Forward party also need to win the mandates to form a government before they can legalize same sex marriage. Wait and see until early August if they succeed in that; no one can give you a useful answer before that time. -
The demise of the village ATM.
khunPer replied to Crossy's topic in Jobs, Economy, Banking, Business, Investments
We unfortunately have to get used to cashless society, just like in my Scandinavia home country – I have a feeling that the taxman there is quite happy to have everything stored in the bank account data... – I however also prefers cash in my pocket, but realized that my neighborhood is going down from 7 ATMs close by till only 2 ATMs within healthy walking distance. But always look at the bright side of live: I get good exercise... -
Indeed, it's mainly depending of the number deposited in your bank account is. However, important are also having good manners, being polite, acting a bit like a gentleman, being well dressed, and being clean and sober... PS: I'm 73 and can still get women younger than 43 to be quite interested in me...????

Sharing custody of a child out of wedlock
khunPer replied to craftyone's topic in Family and Children
Yes. To get parental right when not married, you'll need a DNA-test and a certificate from the family court. Another method – however later – is that hen a child is of age 7, you can go together with the mother and child to the local amphor office, and both will testify that you are the father. You will get a legal certificate from the amphor office. Your name on the birth certificate is fine, but it gives you no rights at all. It might be a benefit if your child get your family name. -

Where would you retire -- if money wasn't an issue?
khunPer replied to gargamon's topic in ASEAN NOW Community Pub
Thailand might still be first option, a few million US dollars is not that much – my neighboring house here in Thailand is for sale, asking price is $2.5 million... -
To my knowledge, you bank deposit cannot be below 400.000 baht. However, as already said, some immigration offices might not accept the combination method, and you shall not expect to be able to use it at the first extension of stay, as you need to show one year of combined transfers and bank deposit.

'Brand name quality'.... –Because a brand name normally reflects quality, that's why many people buy brand name products. A survey showed that mainly people with limited funds boughts brand names, as they couldn't afford to buy something, which didn't have the right quality, throw it away and buy something else instead. Loaded folks can afford that... Every single apple had a sticker. The packing in a plastic bag might be done by the retailer, the producer and exporter normally sells fruit wholesale in a box.
-
Might be a loss – i.e. price increase for the consumer – as the wrapping protects the apple during transportation. Do you wish buy damaged apples? However, someone has to pay for the damaged apples that cannot be sold, so the good apples will be more expensive... The sticker is there, so you can see it's a brand name quality...????

That is correct. In the beginning all families needed to create a family name of two unique sounding syllables, and when there where no more options available with two syllables, it became three syllables and so on. Those registering Thai family names later, as many Chinese migrants, have quite long family names, as they needed four or even more unique sounding syllables in the name. So if a family name is long – i.e. many syllables – it's a fairly late registered name.

This is what the law says... Section 559. If no time for payment of rent is fixed by the contract or by custom, the rent must be paid at the end of each period for which it is stipulated, that is to say: if a property is hired at so much per year, the rent is payable at the end of each year, if a property is hired at so much per month, the rent is payable at the end of each month. Section 560. In case of non-payment of rent, the letter may terminate the contract. But, if the rent is payable at monthly or longer intervals, the letter must first notify the hirer that payment is required within a period not less than fifteen days. Will in Thailand & Australia
khunPer replied to OzMan's topic in Thai Visas, Residency, and Work Permits
Thai lawyers recommend to write two last will, one covering assets in your home country following that laws, and another in Thailand to cover any assets here, following Thai laws (source, the book "Thai Law for Foreigners"). According to Thai law you can decide who is going ti inherit you when writing a will. In principle your children can be sole heirs. If no will – or no valid will – the estate will be divided according to the law, where children is eligible for half of the estate according to Thail law. The law don't mention a cohabiting person, so when you are not married, your girlfriend might not have any right of claims, even if there is no will. However, you should check with a lawyer, as there has been cases where couples living together in some ways have been considered equal to a marriage couple. An estate is normally handled by a court in the country where the deceased had primary residence, but immovable items (real estate) will follow domestic laws. -
And I thought el Nino and la Nina had been here for ages, long before the industrial era... ENSO (El Niño–Southern Oscillation) conditions have occurred at two- to seven-year intervals for at least the past 300 years, but most of them have been weak. Evidence is also strong for El Niño events during the early Holocene epoch 10,000 years ago. (Source: Wikipedia)

Where can I get an English translation of a Thai will form?
khunPer replied to MrMuddle's topic in Chiang Mai
Thai lawyers recommend to make two last will, one for assets in Thailand following the Thai law, and another for assets in one's home country following that laws (source, the book "Thai Law for Foreigners). It makes good sense, especially if real estate is involved, as that will follow domestic laws; i.e. no matter what for example UK law says, a foreigner cannot inherit land in Thailand. Also because, if there is no will – or no valid will – the estate will be distributed according to the law, which in Thailand means only 50% to a spouse. Looked at it in another way, it's better to use both belt and suspenders... There is at present no inheritance tax in Thailand, but that does not prevent foreign heirs from paying tax in their home country...????
