  1. Do you live in the area where your villa is located?

    If you live in another country, it would really be beneficial for you to find a long term renter. If you do not, then all of the high weekly money that you would like to get will be eaten up in commissions, maid service, missing days and weeks of rent, and more.

    And, the more movement of tennants you see, the more likely you are to have a problem. Get a long-term renter and you will be better off over the long haul.

  2. If you have payed late you are in breach of agreement.

    The agreement should have a note about late payments, and the note must be within Thai Law.

    If agreement tells you the consequence of breach, that is what will happen.

    Only if it is within Thai Law.

    If agreement does not tell the consequence of breach, owner can determine agreement as he has noticed you.

    He can only make a determination if it is within the contract and within Thai Law.

    However also depends on how last rent was payed. If the owner has signed for recieving this rent 2 days late, his case is not very strong. If you have payed last rent to his bankaccount without owner signing for it, his case is strong.

    If you made a deposit into his account, late or not, the police and the court are going to take your side. He would need to send you a registered letter and you need to sign for receipt of the letter, return receipt requested. Phone calls are no good.

    If he and his wife appear on YOUR DOORSTEP, do not allow them to enter. They have no right to enter on the current pretences. If they have previously notified you of their need to inspect the property for one security or for structural integrity or a water leak, then that would allow them to look at the property.

    If you have an hour, go down to the bookstore (AsiaBooks, Bookazine, B2S, SE-ED, Book Variety) and take your wife, locate the law book for property, and go through the rental section.

    As long as you have a receipt showing that you made a payment on the 19th, the police are not going to stand beside him, and if he needs to go to court, it will take a couple of months.

    And, if for some reason, he wants you to leave soon, maybe if you leave soon, you can be assured of him having your deposit there for you, while if you stick it out and fight about the current situation, he may make returning the deposit a hassle.

  3. The Developer has tried to negotiate the repayment of this over payment by proposing Baht 100,000 is returned in cash and the other Baht 100,000 used as an advance payment against service charges estimated to be approx 2 ½ years at the rate of Baht 40,000 per year.

    Although from the West, we hate doing it this way, I have to say that in Thailand, it is in your best interests to ... accept the above, for the most part, but the 100,000 which will apply towards the 2 1/2 years, will now apply towards 3 years... time is money. If he is unhappy with that, then ask for it to be returned to you NOW instead.

    NO kidding, I think that if he offered the above, you got off lucky. I know it sounds nuts, but if you are getting your money back withoutt he tie and money and effort of a case in court, you have done well.

    I was going to say pretty much the same thing, possibly ground water being drained.

    If you are in a Moo Ban where many of the other houses were built by the same builder at the same time, ask them if they are experiencing the same thing.

    Also, see if your house, rather than settling, is titling, as one friend's house is doing. Titling like you would not believe. Balls will roll across the floor. Doors will open on their own. Doors no longer close well.

    In either case, it is best to look elsewhere. Where ever you are, there is a lot of vacant property in the neighborhood.

  5. I remember them having a stand on the 4th floor of RoyalGarden about three years ago. I think it lasted one month.

    I noticed that on opening day in CF, business was robust. Who knows how long it will last. I agree with the OP, I have no reason to ever have another one.

    For breads, I think for 35 baht, the giant cinammon bun (enough for two people) for sale in the basement of Central-Beach Road, at St. Tolent or something like that, is the best buy in town.

    Years ago, I had a 14+ y.o. 100cc Dream

    I bored it out to 125 and installed a larger muffler

    The larger muffler really made a differnce once the throttle was turned more than half-way.

    I have a Honda Wave 125 which I have just modified the engine.

    I willl do the muffler next and also either drill some holes in the airbox or change the filter system.

  8. I am going to take a guess that you already have a copy of this person's tabien ban / ID card so you know where he comes from.

    Go to the land office in the tabien ban area and see if he has land there. After showing the judgement, they will comply fully. Also, check at the Motor Vehicle department. Showing the judgement, they will be happy to help.

    The police also have the ability to look through the national database for motor vehicles. A small tip will go a long way.

    The land offices are not on a national database, sadly.

    If this rule does not show up before then, it is irrelevant. This is like putting the rules on the prize being received. If the rules are not on the board advertising the coupons, then to hel_l with them. Sir, you are more than likely not the only one who has done what you have done, and the rest of us are all the better because of it.

    I have bought "buy one get one free" packs of milk before, and had the cashier / information desk argue about it not being correct. Then, others show up and complain too. All of the sudden, the store employees are allowing the second 6-pack of milk to be free. Not unusual here at all.

    One client bought a house from me. He wanted a washer-dryer combo. He bought it at Home-Pro. It did not really dry the clothes. We had the serivce people come out. Showed them. They left and another two guys came out. One hour of drying (they wanted to dry light-weight synthetics, we said "NO WAY" and threw in real clothes. One hour later, the clothes were still wet. They wanted another hour of drying. We said "No". We told them to take the machine back with them.

    We then returned to HP and talked with the employee and two managers. They gave us different definitions of "dry". Dry for ironing and dry for hanging up. We gave them one definition for dry: Dry = no water. They told us that the brochure may not be accurate. IWe told them then we will write to the manufaturer and discuss our situation with HP if that would assist them. They finally backed down and stopped wasting our time and gave us a 35,000 baht voucher, which my client used for a new washer, a new dryer and some other things the next week.

    I did not find this to be all of HP's fault. The manufacturer sold a product which did not do as it's brochure stated. HP should contact the manufacturer and let htem know that they need to change their brochure and or include and additional sheet of information.

    HP finally did the right thing, but they should have done it more quickly than they did.

    Stores here will do anything and everything to avoid responsibility and it is necessary to force them to abide by what is right.

    HP once mixed paint for me--the wrong color. The paint did not match the sample. It was a hassle, but I got them to take it back. If no one does it, then it will never get better. It may never improve a whole hel_l of a lot anyway, but I am not, and neither is the OP, going to be taken advantage of.

    And, if there is a stuid rule, point it out the them.

    TR: No taste. Maybe it is the owner's wife there who has absolutley no interest in welcoming the customers or responding to them. I have no idea how this woman can stay in the restaurant's employ unless she is the owner's wife. She is outright rude.

    Blue Parrot: Greasy over-priced chips. Average food. Poor ambience, no a/c.

    Beefeaters: 250 baht? Average Mexican food plus ribs, too.

    For those of you who eat at the good Mex restaurants in Bkk, let them know that Pattaya is waiting and they would have no competition.

    And "No", restaurants do not deserve a second chance.

  11. Some good advice, especially on the sell with buy back rights.

    If you register a loan and they default on paying back, you'll have to go through a lengthy legal process (several years), and even then might not see your money, nor get the property transferred to you!

    Get Land Office powers of attorney signed first, so if he does default, you go to the land office and change everything to your name right over.

    It does not take so long as above..

    On a defaulted mortgage: Your lawyer sends the borrower a letter that they have broken the agreement in the contract and that they must make contact and arrangements to catch up on their payments.

    The borrower does nothing, and then you notify the court. It will take about 3-4 months to get to court. Usually, the borrower will not appear and the lender will be given the right to send the property to auction. This may take 6 months until it is auctioned off.

    If the borrower does appear in court, he will more tha likely beg and plead for more time, but as the borrower had not gotten a hold of the lawyer or the lending parties earlier , the court will not want to hear it.

    After the auction, the auction house will then contact you or the court, I forgot, and you will pick up your judgement money.

    BUT NO KIDDING, do a Kai Fark instead, if the copndo is in a Farang name. Then, there are no problems.

    30% ROI sounds rather high if the rental money will be used to make the payments. There would not be any ROI untilt he property is paid off unless the rental amount is in excess of the payments.

    How high are the payments for 10 years, and how much do you expect to have to use for furnishing?

    What about yearly maintenance fees?

  13. also you should get a letter from the condo company stating that he has paid all of his maintenance fees up to date.

    This way, you would not become liable for them.

    The land office has a Power of Attorney form for him to sign.

    Instead, you may be able to do what is called "Kai fark"

    This means Sell with the rights to buy it back

    This way, it is already yours.

    You--being a foreigner, can do this only for a condo in a foreigners name.

    Write the loan up for more than you loan him, and refer to these extra costs as fees. This way, it will pay for your hassle now and in the future if you ever have any.
