    I recently tried to move to Pattaya from Bangkok and file my retirement extension application and TM 28 at the same time. I was planning to reside in a Pattaya hotel and they provided a letter to Immigration. I was residing in the hotel at the time of the application. I had made a future long stay reservation confirmed with a credit card. I presented all supporting documentation. The Immigration Officer and his Supervisor approved everything, but denied my extension in Pattaya based on the fact their rule is the applicant must live in Pattaya six months before they will approve an extension of stay in Pattaya! They referred me back to Bangkok to apply where it was originally issued. They didn't even want to take the TM 28!  I've been living here going on 11 years.  Now they prevent you from moving unless you want to start all over with a non O!

     

    My question;  is this even a written law or a new unwritten procedure?

     

     

     

  2. When changing your address from one Province to another, do you fill out form TM 28?  What copies do you have to attach to it if any?

    Can you mail it in or do you have to go in person and which office do you go to?  The Immigration office in the Province you are moving to?  Do you have to notify the local Police Dept. as the form says?

    If you were applying for a retirement extension of stay in the new Province at the same time when do you present the change of address form, before or after?

    Before making  sarcastic remarks you should understand the written rules in the Immigration's own website regarding combination of funds.  Not only do you look foolish, your content could be alleged by some as being a Troll.  Apparently you didn't even take time to read my entire explaination and all the responses.

    Today, was a very disappointing day.

     

    My extension was denied and was told to come back after my bank funds were seasoned by 3 months which is only a few weeks away as I recall. Please note that I presented the combination 800,000+ in the Thai bank plus my monthly foreign income and Embassy letter.

     

    I was also told that my savings book had to be updated today!  I was never told this before in past years. My bank certification letter and savings book was dated yesterday.  That request is absurd as I had to get at District 1 Immigration at 7 am and even then I was 40th in line! The banks were closed. On the way home I tried to update it by the bank machine at the BTS and a error message said, 'see staff, magnetic error."!

     

    I had a very frustrating 15 minute conversation with the supervisor and she would not listen to anything I presented, including the copy of their own Q&A off their web site.

     

    A very disgusting day indeed.

     

    I had to cancel my future trip so I could return to the gauntlet in a few weeks. 

     

    The Supervisor tried to sell starting all over with an O visa if the retirement extension expired while I was out of the country.

     

    A real waste of time for me and the Officers.

     

    I saw many applicants arguing with Supervisors.

     

    I can understand now why many expats are leaving.

     

    After 10 years living here, I did not feel welcome today,  whatsoever.

     

    It would be a whole lot easier for them and for us if they would just follow their own written rules!

    It takes years for most men to understand that most Thai women, as most women today with Internet access, are better dealers and it's all about security and cash!

     

    Most women are becoming more Independant, have less interest in having children, and that creates problems for long term relationships.

     Have you ever tried to show a map to a taxi driver that needed glasses?

     

    I believe many tourists are denied rides by taxi drivers that are holding maps as the older drivers know they can't read them.   :cheesy:

     

    I lived with a Thai woman for 4 years and I begged her to get glasses as she had problems reading. Her entire family needed prescription glasses, but none never went in for an eye exam.

     

    i could never understand their thinking.

     

    They just don't like glasses!

    I agree there is no written rule of law that seasoning is required for the combination method. The last big word in sentance 4, is the 'OR' word.  Clearly, that separates the rule between 4 and 5, and changes the intent.

     

    i decided to go to Immigration with all my supporting documents and extension application and if denied coming early, ask for consideration, I will explain that a precedent has been established recently by Immigration Officers reviewing similar situations and they were reviewed on a case to case basics.  I will respectfully request the same consideration.  I will post the outcome and hopefully a happy face will appear!

    Does anyone know if Bangkok District 1 Immigration Office enforce seasoning of bank funds on the combination method.  If so, was it recently.  Is it possible to telephone them and speak with a Immigration Supervisor?

    I do have a pension and would qualify if Immigration accepted the combination pension, Thai bank deposit under rule 5 and waived the 3 month rule.

     

    Urbon Joe, please forward a followup comment on this now that I have revealed I have foreign income I could use.  Thank you for your first comment.

     

    Attached is a screen shot taken from the recent Thai Immigration Website regarding the retirement extension rules.

    The content in (#5) does not mention, 'for the past 3 months seasoning of funds.'  It simply states the combination must total no less than 800,000 as of the filing date. 

     

    As I recall, I have read in the past some offices, I believe Pattaya Immigration was approving combination income retirement application extensions without funds being seasoned for 3 months.

     

    I would be interested in hearing from anyone that recently had their retirement extension application approved using the combination method without the seasoning of bank funds and what office approved it.

  11. My retirement extension expires on November 1, 2016.

    This will be my third retirement extension. (3 months of seasoning required)

    I deposited 800,000+ in my savings account on July 21, 2016, which gives me the 3 months required if I filed my application the end of October, 2016. (Remainder of July, August, September and October)

    I have to leave Thailand on September 23, 2016, and I’m not sure when I can return.

    I was planning on going to District 1, Immigration in Bangkok 45 days early, as I have done before, on September 20, 2016, to file for my extension.

     

    My question is would Immigration make an exception regarding the 3 month rule at the time of the early application with travel documents and look at the July deposit date and the November 1 expiration date which would be over 90 days of seasoning.   The bank funds will remain in the bank for one year. They have already been in part of July, all of August, and will be in 20 days in September.

  12. Better to consult with a competent law firm and have them show you the written law in Thailand, and recent Court decisions.

     

     I owned a P.I. Agency and a Insurance Adjustment Co. for 30 years.

     

    Much of the information you are getting here is not 100 per cent accurate even in the U.S. In the U.S. courts do allow recordings in specific circumstances such as a death or for impeachment purposes. In some states it may be legal to record a telephone conversation without having gotten permission, as long as you were party to the conversation. Where it can get complicated is if you're calling another state where it's illegal.

     

    This is a subject that can get very complicated and you're not totally safe unless you actually look at the specific written statutes and even recent Court decisions that can set a precedent.

     

    Keep in mind if you record a conversation and say something not politically correct or illegal, that recording might be subpoenaed and used to prosecute you. In some countries you might not even get to trial!

    Before you can apply for the extension you need to enter the country with a new non immigrant visa, OR if you enter as a tourist you need to convert that entry to a non immigrant visa/entry.

     

    However you achieve the 90 day non immigrant visa entry you can apply for the extension of stay within the last 30 (maybe 45) days.

    The Immigration stamp in a passport is the visa!  If you look up the definition of a visa in Blacks law dictionary that will confirm it.  Therefore, one does not have to be specific in stating a retirement extension.  The stamp, the visa, clearly says retirement!  The ultiment goal is to secure a retirement visa.

    Your response is <removed>! I was referring to worldwide currency retreats that the dollar has created.

    The US$ vs the THB is currently in retreat from the dollar highs. It will continue with the continued massive sell offs of US Treasuries worldwide, and will be a problem for US citizens qualifying for a combination financial retirement extension. Especially when the US dollar is devalued by 1/3 in a few months. Don't believe it, wait and see. Save this post to read and weep.
