Why does your rental agreement state your move in date?

My rental contracts only stated the date I started renting the property, it doesn't mean that I moved in on this date.

Well i thought you must do your TM30 when you move to a new house or a new place. And i think IO consider the date on the contract as you moved already. I dont know. But it sounds logical. This is thai IO, do you think they will understand the issue?

There is no rule that states you must move into an apartment on the date you start renting. There is no way for immigration to know what date you actually moved in, and I will be very surprised if Immigration tries to make an issue out of it.

Just wondering they wont understand from the rental contract? there is a date on it doesnt immigration consider that date as your starting living there and do your TM30 accordingly?

    thanks

  3. Hi guys,

So i bought a new house and of course i want to design my garden and so on. In first 2-3 months i didnt touch the garden due to some reasons, so i just let other house cars park which i really hate. Tbh i hate cars blocking my view. thats the reason why i bought a house with the garden. And also i dont want to see cars when i look out of my window. I cannot understand why people dont park in front of their house or in garage too! Now there is this small soi connecting other roads in the village. By village i mean the place i bought the house, there are many houses in the same place. Its not a village we know but thai people call it village or Muu Ban. Mine is Suphalai.

Anyway, I started to do my garden, really spending money and want to make it nice for my pleasure. Meanwhile I put a sigh saying please dont park here. Also dont smoke. Because yes, there is an idiot keep smoking in front of my house and throw everything there. Well after the sign he stopped smoking and talking with me which i kinda dont care. But again some of the cars keep parking and some stopped parking. So i went to homepro and bought traffic cone (3 of them) and a traffic chain to connect 3 cones. And put them in front of my garden. They are on the soi but not blocking or any harm to anything. maybe 80cm from my fence. Well everyone got the message and stopped parking. But after 2 or 3 weeks later, someone from the village office came and told me that i cannot put that cones there because its public area. I didnt resist or argue too much which i now think i should. Anyway i took the cones and now in front of the house has no cones. First day today and so far no cars parked. Im sure they know i dont want them to park there.

Now, after dinner i was thinking about this and called my lawyer. i know sounds stupid but i did. He told me he needs to see the contract about the house and also must ask to the office about the soi side juristic regulations of that soi belong to village or private. Also he told me if there is anything in the house contract (i checked and nothing about it). Well i will not go to the office and ask for more details.

But i was wondering about something... If i dont block the soi (i was also not but it was kinda on the soi too BUT again was not blocking any car or anything) and put that cones like touching to my garden fences. Will not be on the soi but like really next to it. At the end of the day its in front of my home! So if you know anything about this please let me know.

My last decision is to prepare a sign saying very politely and nicely please dont park in front of my home and hang it on my fence. Im pretty sure office cannot say anything to that. Ohh i forgot to mention that also the office say i cannot put the cones but if a car makes loud noise or likewise things i can tell to the office and they will contact with the owner of the car. Which probably will lead more problems.

Well any info or suggestions on this please?

    thanks a lot!

  4. hi,

well, sad to hear that. i hope you can take the test soon.

tbh its nothing for thai schools.. or means anything to them. because if you go.. there are another 10000000000 farang on the list waiting for a job. and they like students see new faces. you will understand what im talking about in the coming years of your teaching experience in thailand...

best you can do at the moment is to look for another school.

    Hi,

    Thanks for the input.

Just to clarify a few things:

I'm on my last waiver. I was granted an extra waiver (2 years) as I proved to Kurusapa that I was studying for a post graduate certificate. My waiver will end in June and my visa ends end of this month.

This is my second school, yes.

I have 2 colleagues who also did the PGCEi with UoN and were granted a 5 year license (a few years back). The PGCEi from UoN is on the Kurusapa list of accepted institutes and qualifications. I also know a couple ex-colleagues who did the St. Roberts diploma (the Filipino course), and that is recognised by Kurusapa. Neither of these certificates (UoN or St. Roberts) required further tests from Kurusapa. Also, one of the people I'm referring to who did the St Roberts course waited a whole two years before applying for a 5 year license (just two years ago). So me having to do a test 4 months post graduation doesn't add up ...

    hi again,

yes, this clears few things now. I really believe they want you to take a test for your 5 year teacher license because your all waiver letters are.. dead.

Now you said the course you took is recognized by krusapa and no need to take any test but directly teacher license. Maybe few things changed since im not teaching anymore but back then i knew few teachers with some kind of legit teaching degree but had to take the exam. the reason was about some kind of lesson credits which they had not enough. There must be a certain number of lesson credits you should have after completing the course. Im sorry cannot remember the number. you might have the same problem, although you mentioned your friends or some ppl you know got the same course and got their license without any problem.

another option is maybe krusapa not accept those courses anymore..

another option which is also very common is, the teacher at your school just ignored and not bothered to explain your situation clearly to krusapa. This happens because of the thing i mentioned you before.. you are nothing and have no value for thai teachers there and simply they dont want to spend their time for you.

So, i strongly suggest you to go to Krusapa by yourself, and ask the people there showing the documents. Being there changes many things, trust me. Thats why i always personally went to krusapa by myself while other farang teachers were laughing at me and having fun of me. But they got their lesson at the end of the day when they saw i have the license but they couldnt because of miscommunication between school and krusapa)

About the test; i never took the test tbh. but i know lot of ppl took it. The common comment was it was really hard. If you are not graduated as a teacher it will be really hard one. If i remember correctly, there were class theories or analyzing them, etc. things in it. So if you dont have some really good educational or academical background it will be a nightmare. I had some friends took it 2-3 times to pass.. some friends couldnt and gave up, some played lottery with choices and got it..

    good luck

  6. Hi,

i believe this is your first or second teaching job in Thailand.

First lets start with the process.. preparing documents should take as long as the printer speed at school which is probably 5-10 secs. And then that documents must signed by the school principal which can be done in 1-2 days normally. But dont forget that you are a teacher at a thai school which means you have no value at all, so your documents comes the last and i mean it. So yes, 2 day process may take months and im not joking. I was teaching before but not anymore.

Now.. is this your 2nd year at this school? If so, yes you need a 5 year teacher license. Because you can teach only 2 years with a weaver letter from the KRUSAPA at the same school. Then if you want to continue there you must apply for a real teacher license. Now if you teach at university you dont need this license thing because universities are not connected to KRUSAPA.

To get a 5 year teacher license you need to graduated as a teacher or holding a master degree in education or studying a master degree in education. I dont think (i might be wrong) that UoN PGCEi course will give you any right to get a license unless its a 4 year or similar education. This is where the test comes. This test might be the test krusapa does to give you 5 years teacher license.

Another thing is, when they see your course degree, krusapa might thought that you are applying for 5 year teacher license instead of 2 year. Decide which one you want and tell the teacher to ask krusapa again.

    good luck

  7. Hi,

With all respect i think this is your first time teaching in thailand or second. I think that because you are obviously not familier with working conditions in thailand. I was teaching marketing at a university then i quitted kind of same issues every teacher in thailand having. Now im working in a military company.

About your problems. I dont know i can help or not but let me mention few things that some users wrote here and also your comment.

Yes, it is probably true that they cancelled your work permit BUT its not true or possible that they can cancel your visa.

Yes, you need that termination letter both for changing your visa or leaving the country. Now for leaving the country there are different things going on. In my case they didnt let me go out without that letter. Some.. they did. Its surely up to the IO. But i believe the right way they cannot let you go without that letter, because they dont know or sure if your running away or likewise situation.

If your school not giving you that letter which seems to just trying to things make worst for you, you can report them to labor office or even to police. I suggest you to go and ask about this to labor office.

    good luck

  9. Hi,

i have non-o married and extended via agency (29K baht)

sadly my 8 year marriage finished officially 1 month ago. I didnt go to immigration to tell my situation. Im still on my marriage visa and i also have work permit too.

good thing is they not check.

you are still married on paper. no need to panic. but soon or later she will ask for that too probably. So if you want PM me and i can give you the agency contact i used. They can extend your visa but will be not the same city you are living. probably Esan area

I'm just wondering why this guy is coming to you for advice when you clearly don't know?

The answer is to direct him to a law firm that deals with such matters, someone like Siam Legal perhaps?

In fact they have a section on forming representative offices right here https://www.siam-legal.com/Business-in-Thailand/thailand-representative-office.php

because im his friend and he just wanted to know the basic things first. They cannot come here because of covid.

thanks for the info. I also recommended them to do it via lawyer.

  11. Hi guys,

A Turkish military company wants to open a branch office in Bangkok. Someone from their company will be the director of the office. They will be only responsible to find some products and follow up the purchasing and other related small things . Their duty and responsibilities are not that serious.

They asked me to find some info about this matter. First of all they need to know how to open an office. Please note that not starting a new company or likewise. Just a representative office in Bangkok. So if you guys can tell me what they need to do kind of step by step, would be great.

As far as i know they need to hire an office, 4 thai employee, director will be their man and they will hire from bangkok for this position. The man lives here already and they want to give the position to him.

So please let me know about the steps how to open an office and i will tell them.

    thanks a lot.

The requirements are listed in documents 12 and 13 found in this thread: https://forum.thaivisa.com/topic/981135-laws-regulations-police-orders-etc/

As you can see, the requirement to apply for an extension based on working is to have any non-immigrant visa, which you have, you don't need a non-b visa.

The information which you got from your office HR is just wrong.

and can i do this after divorce? because i will divorce tomorrow morning.. all that documents probably cant finish in 1 day.

    thnx for the link

PS: i cannot find the section you mentioned.. can you say which one please?

  13. Just now, jackdd said:

You don't need to leave Thailand and you also don't have to change from a non-o to non-b (that's not possible anyway).

All you have to do is apply for an extension based on working, using form TM7 and provide the required documents.

i asked about this to my office HR. who knows well about these because shes doing all paper work for visas and work permits. She said it cannot be done. And yes khon kaen immigration also not doing it. im in bangkok but i first tried at KK immigration. because your visa and work situation is different. visa is for marriage. i dont think they will extend it for work. but if you know a way please tell me. thanks

    Please keep updating this topic.

I also want to divorce my Thai wife (waiting for better personal finances first) and want to know the best way and what could happen.

Currently married for 23 years and daughter 22 years old all my money gone to family for house, cars, university plus all monthly bills and living costs. I am 54 years old.

My name is not on anything but plan to soon try to get my name on the house documents if it means anything i'm not sure. I believe everything owned in Thailand during marriage is available to attempt for 50/50 but we are still paying the house off for several more years. But she would never sell it and has no money or other assets to attempt for.

any advise on requirements and relatively painless way to do this thanks

    hi jeff,

you need to talk to your wife. and convince her to divorce at amphue. its the easiest. takes 3-4 min to finish all things. but if she starts to ask for the house and other things, yes everything is 50-50 for the things after you married.

    IMO

Not having re-entry permit in passport is not a problem for departures, but the extension is needed to be valid (no overstay), no re-entry permit is the passport holder decision (no return, or changing visa type).
Besides that, he would be able to obtain a re-entry permit before departing while the extension is still valid. Perhaps next Jan by the same agency or no agency.

yes leaving is no problem if not overstay. And probably thats what im going to do. leave and get a new visa in next july or before. meanwhile stay away from immigration. last 7-8 years i never ever even passed front of their door. So probably i wont now too. As everyone mentioned yes its illegal to do so but also immigration will not know about my situation unless i go there and tell them by myself.

  16. On 11/24/2020 at 3:09 PM, jackdd said:

Why don't you just apply for an extension based on working?

to do that i need to leave the country and go back to my own country. there are 22 listed countries that cannot get non-b from near countries to thailand. If i go out, well you know the rest because of covid its kinda very difficult to come back.

im sure you cannot change your non-o to non-b in thailand too.

  17. Just now, problemfarang said:

i think changing my non-o to non-b can be done by only agent. because i never heard of in normal ways. then what can happen when im doing my work permit or else? so thats a higher risk. Im still with plan A: wait till july or any suitable time before that. leave and get a new non-b and come back. also if i remember they write where i work or something like on non-b visa. so i think its really complicated.

    thnx
