Hi Seniors,

 

I been reading up but some parts still don't gel together for me and I will like to get some clarity please if any kind soul can advise:

 

I have a non o multiple entry (thai spouse) visa from the thai embassy in singapore.

 

I am looking to enter thailand early Oct, stay for 2-3 weeks and exit again. I will then renter for a longer stay around Nov. My questions that need some clarity:

 

1) I did ask the Embassy and they said with my marriage visa I can go in/out Thailand freely up to 90 days each time and I understood I have to do border runs every 90 days. However, I also read that I needed to convert this non O (thai spouse) visa to a marriage visa at within the last 30 days of the first 90 day period? This is where I am confused.

 

1a) On this similar point, do i need to report to the immigration bureau or police station every 90 days? There is some form TM30 that needs to be filled? I be living with my wife in our house and she has the blue book in her name

 

1b) Assuming I leave the country (via flight) before 90 days, I then assume this "border run" is complete. I am also confused about the need for some re-entry permit?

 

2) After my visa expires in a year, do I then need to obtain another 1 year non O (thai spouse) outside of Thailand or can I extend it (for a further year) in the country. I read that I can also extend the 90 day reporting period to 5 months instead based on marriage?

 

If some kind soul can let me know how this is to be done, I will greatly appreciate. Thank you in advance!

1. You can apply for a one year extension of stay (it is not a visa) based upon marriage during the last 30 days of any the 90 day entries from your visa. You would need 400k baht in a Thai bank in your name only for 2 months or proof of 40k baht income.

1a You only need to do 90 day reports at immigration if you get the one year extension of stay that allows you to stay longer than 90 days.

      The TM30 form is for your wife to report you are staying in her house. Whether the report is needed or not depends upon the designated office for where you are living or if you need to anything at immigration.

2. You would have to get a new non-o visa at a embassy or consulate. Or you could apply for the one year extension of stay.

You can extend any of the 90 day entries for 60 days to visit your wife at your local immigration office.

Thank you ubonjoe for your swift and helpful reply, I appreciate it. If I may reinforce my understanding please:

 

1.)  I assume I will apply the one year extension of stay during the 4th 90 days stay since that will maximise my visa validity.

1a) Riding off the above point, after I have done the 1 year extension of stay will my non O multiple entry still be valid or it gets "converted" to the 1 year extension?

Assuming I am not visiting the immigration bureau, I wont need to bother myself with TM30 form

2. I assume this is based on the non O visa after 90 days expires I can extend for a further 60 days by paying 1900B in lieu of doing a border run. 

 

On the border run, I will be based at CHiang Mai so will going in/out to Tachilek count?

as you will come into contact at some time with immigration, do the report if your immigration office requires it.

 

if you do an entry into Thailand just before the expiry date of the visa from Singapore, that will stretch the 'visa' to 15 months, if during this last entry you require a trip out of the country then a re-entry permit will be required, to keep the expiry date of the permission to stay stamp alive.

 

you can then extend your last permission to stay stamp in the last 30 days for a period of one year, reason to support/visit Thai wife, (1,900 baht) requirements as posted by ubon.

 

your 'visa' is finished/is no more/expired on the use by/expiry date.

 

you can do a 60 day visit Thai wife extension once per 90 day entry.

1) You might choose to make a border hop just before expiry of your visa, thus getting a fresh 90-day stay that may be extended by 60 days. If you do that, it would likely be your 5th entry using the visa.

1 (a) An extension is of your permission to stay (not of your visa). You will be extending a non immigrant permission to stay. Nothing is converted.

If you are applying for an extension in Chiang Mai, you will need to ensure the TM-30 notification has been done.

2) Near the end of any permission to stay (but only once per entry into Thailand) you can apply for a 60-day extension to visit your spouse.

 

When entering Thailand at any entry point open to international travelers, you will receive a 90-day permission to stay from from multi Non O visa.

1. If you want to wait until you have done the last 90 day entry from the visa that is up to you. If you get tired of leaving every 90 days you can do it during the last 30 day of any of the entries.

1a Your non-o is not converted to anything.

If your visa was still valid you would not be able to use it for an entry after you get the extension since that would invalidate your extension because you would get a new 90 day entry. You have to use a re-entry permit to keep the extension valid if you want to travel.

2. You would apply for the 60 day extension during the last couple of weeks of a 90 day entry from the visa. If you did the application after the 90 days ends you would be on an overstay.

No problem to your border hops for a new entry at Mae Sai/Tachilek.

Hi ubonjoe, thank you for the helpful answers!

 

I am getting a firmer picture now. Given that if I expect to be in/out of the country for travels, it will make sense to retain my multi entry non o or go for short trips every 90 days.

If I am staying for a longer period with no plans to leave the country, I will apply for a stay of extension so I dont have to do bother runs but then again paying for that B1900 will probably work out to be the same

can I clarify something:

when I entered Thailand’s I was given 30 days on my passport which is what I would have normally received for my pasport without a visa.

 

to clarify:

I am aware my current visa type allows me a stay up to 90 days. Do I ignore the 30 days given on my passport by virtue of my visa or did immigration do something wrong? 

 

If it is wrong do I have to rectify anything?

If the Immigration Officer stamped you in for only 30 days and you have a valid non o visa, then this was in error and needs correcting.

You need to go to the immigration office local to where you are staying and get this correct soonest.

 

As a matter of interest, did you put your visa number on to the TM6 in the boxes for that purpose?

Thank you Matt. I leave the country in 2 weeks and won’t hit 30 days so I suppose this is ok.

 

in the event I stay past 30 days they can’t fault me since I have the appropriate visa right? Or not since TIT. :(

 

Yes I included my visa number in the immigration form.

Best to go to immigration to have it fixed if you are going to stay over 30 days. You could be charged for overstay if you stayed longer than 30 days when you leave the country.
