Trump calls for death penalty for Uzbek man charged in New York attack

NEW YORK (Reuters) - U.S. President Donald Trump called for the death penalty on Wednesday for an Uzbek immigrant accused of plowing a truck down a New York City bike path, killing eight people, describing the man as a "terrorist."

 

Sayfullo Saipov, 29, who was hospitalized after he was shot by a police officer and arrested, told investigators he had been inspired by watching Islamic State videos and began planning Tuesday's attack a year ago, according to a criminal complaint filed against him on Wednesday.

 

"NYC terrorist was happy as he asked to hang ISIS flag in his hospital room. He killed 8 people, badly injured 12. SHOULD GET DEATH PENALTY!" Trump tweeted.

 

Saipov was charged with one count of providing material support and resources to a foreign terrorist organization, specifically Islamic State, and one count of violence and destruction of motor vehicles causing the deaths of eight people.

 

Manhattan acting U.S. Attorney Joon Kim said the first count carries a maximum penalty of life in prison, while the second would make Saipov eligible for capital punishment if convicted, if the government chose to seek the death penalty. Additional or different charges could be brought later in an indictment, Kim said.

 

Vehicle assaults similar to the New York attack took place in Spain in August and in France and Germany last year, claiming dozens of lives.

 

Saipov confessed to authorities that he made a trial run with a rental truck on Oct. 22 to practice turning the vehicle and "stated that he felt good about what he had done" after the attack, the complaint said.

 

The 10-page charging document said Saipov waived his rights to remain silent and avoid self-incrimination in agreeing to speak to investigators without an attorney present from his bed at Bellevue Hospital Center in Manhattan.

 

The complaint said Saipov had requested permission to display the flag of the Islamic State militant group in his hospital room.

 

It said he was particularly motivated by seeing a video in which Abu Bakr al-Baghdadi, who led the campaign by Islamic State - also known as ISIS - to seize territory for a self-proclaimed caliphate within Iraq and Syria, exhorted Muslims in the United States and elsewhere to support the group's cause.

 

Investigators found thousands of ISIS-related propaganda images and videos on a cellphone belonging to Saipov, including video clips showing ISIS prisoners being beheaded, run over by a tank and shot in the face, the complaint said.

 

The Federal Bureau of Investigation said it had located another Uzbek man, Mukhammadzoir Kadirov, 32, wanted for questioning as a person of interest in the attack.

 

U.S. law enforcement officials, speaking on condition of anonymity because the investigation was ongoing, told Reuters that Saipov had been in contact with Kadirov and another person of interest in the investigation, though they did not elaborate.

 

ASSAULT DEADLIEST SINCE SEPT. 11, 2001

 

Tuesday's assault was the deadliest in New York City since Sept. 11, 2001, when suicide hijackers crashed two jetliners into the World Trade Center, killing more than 2,600 people.

 

Of those killed, five were Argentine tourists, who were among a group of friends visiting New York to celebrate the 30th anniversary of their high school graduation, one was a Belgian citizen, one was a New York resident and one lived in New Jersey.

 

Saipov allegedly used a pickup truck rented from a New Jersey Home Depot store to run down pedestrians and cyclists along a 20-block stretch of the bike path that runs along the Hudson River before slamming into a school bus.

 

According to authorities, he then exited his vehicle shouting "Allahu Akbar" - Arabic for "God is greatest" - and brandishing what turned out to be a paint-ball gun and a pellet gun before a police officer shot him in the abdomen.

 

Saipov lived in Paterson, New Jersey, a one-time industrial hub about 25 miles (40 km) northwest of lower Manhattan.

 

Saipov, seated in a wheelchair, appeared for a brief hearing in Manhattan federal court Wednesday evening before Magistrate Judge Barbara Moses, appointed public defense attorney David Patton to represent him.

 

Saipov did not ask for bail and was remanded to federal custody. It was not immediately clear where he would be held.

 

Earlier in the day, Trump said he would be open to transferring Saipov to the military prison at Guantanamo Bay, Cuba, where other suspects including alleged Sept. 11 plotters are held.

 

Kim, the federal prosecutor, said there was nothing about charging Saipov in civilian court that would necessarily prevent him from later being declared an enemy combatant.

And of course, that's his primary duty as President, inciter for the angry mob. For the chief executive of the federal govt. to contaminate the legal process is actually a good thing.

Can't see the connection.  Westerners are all infidels and the scourge of the earth according to the terrorists so if westerners acted in the same way as they do they would probably be fine about it.  They are the one's who become martyrs (in their eyes).

 

But back on topic.... By Trump tweeting the comments about the death sentence for Saipov he actually jeopardises the case against him if the defence argues that it means he cannot get a fair trial.  Trump sets new depths of stupidity almost daily.

There are millions of people who share the same feelings as Mr. Trump ,don't you think? He Tweet's to get his message out.Besides the defense can't argue .The excrement already admitted to the crime.

Not sure how many people are that stupid.  I do agree that there are millions out there that respond in a knee-jerk way and speak (or tweet) before engaging their brain.  Extremely worrying when that includes the president of the USA.

It seems lawyers and legal experts in the USA disagree with you. It is a fact that in a civilised and law abiding society everyone must be given the right to a fair trial and fair treatment as part of the judicial process, regardless of how heinous someones crimes are. Trump has jeopardised that process because he does not have the maturity or intellect to keep his mouth shut and let the legal process take it's course.

How else would he get his message out?The President is human and speaks his mind. Most of the time it's a effective way of communicating. Fortunately there are millions who really don't care how he get's his message communicated. He wasn't elected because of his lack of politically correct prose .

It has nothing to do with being politically correct. What separates the US from the radical Islam world is an adherence to a fair and unbiased trial. Donald Trump as President of the US should have kept his mouth quiet and let the courts decide the disposition.  In America- everyone gets a jury trial but an unbiased jury is needed. Trump has given the defense ammunition to delay prosecution and possibly jeopardize the case. Declaring the perpetrator an enemy combatant is absurd and sending him to Guantanamo a violation of everything America stands for. Guantanamo is an abomination that will go down in History as a concentration camp. You cannot hold people indefinitely without charges and a trial.

The guy already admitted to the crime.The defense doesn't exist it's just a formality now.Mr. Trump didn't say enough

Yes.  Torture the guy, maybe let people throw rocks at him before beheading him.  And then fly a cruise missile into a building back in his home country to teach them all a lesson?  And why not start cutting the hands off of any immigrant caught stealing?  And publicly shaming and beating any woman who dares to associate with a Muslim man?  Well done.  I never thought that so many Trump fans would be supporters of Sharia law.  Seems that radical Islam and radical Trumpism aren't that far apart after all.

If this guy can't get a fair trial and therefore doesn't get the death penalty, you'll have Trump to thank for that.  Here's what two federal prosecutors had to say about Trump's latest case of verbal incontinence:

Death penalty cases cost an average of $1.26 million. A regular prisoner costs about $60k/year.  Maintaining a death row prisoner costs taxpayers $150,000/year.

 

Proposed solution: If he's found guilty in court, send him to someplace like Somalia, where they will gladly kill him for $3,000.  Bullet to the head. Pow!  He's gone. 

 

Trump is beyond imbicilic for publicly calling the buttplug guilty.  That guarantees him a many-years' long appeal process or possibly life in prison.  If he lives decades in prison, that's many millions of $$'s.   If it's at Gitmo, it will be several times more.   The US does one thing very well:  spends insanely more for things than it should/could.

You know what's even worse?  Days after the Charlottesville attack where a white nationalist drove his car into a crowd of counter-protestors, Trump hesitated for two days before saying anything:

For god sake! When is this man going to realize that he is the president. Not a twitter fan that is going to engage privately and personally in a single matter.
Leave it up to the courts to decide, as usual. Again he shows what a moron he is.
Death penalty or life in jail without parole is not the question here- The question is when people are going to see Trump´s poor knowledge about the position he has been given by the voters.

Sixty-two percent see it.  Thirty-three percent see it but don't care because he's on their team.  They don't care if the country is on fire as long as their guy is holding the biggest blowtorch.  We have some of those partisan cheerleaders right here with us.
