I recently legitimised myself as the legal father of my son (2yo) by applying to the court and received a favourable court ruling from the judge. I haven't lodged this at the Amphur where my son is registered yet as I have separated from my sons mother (he lives with me) and she isn't co operating or more to the point couldn't be bothered. We both live a considerable distance away from the particular Amphur. Apparently the mother doesn't need to be present for me to lodge this but the Amphur office in question seems to think she does so I am going to have to get a lawyer etc more than likely. I am registered as the father on the birth certificate and Tabien baan also.

 

My question is, to claim a one year extension as a parent of a Thai child, will immigration accept the court letter as proof I am the legal father or will they check it is all registered and complete at the amphur?

Unlikely that they would accept the letter alone, but you could ask. That type of extension needs signing off at regional level, so their hands might be tied.

 

I would get the right paperwork from the Amphoe if I were you.

 

You could try for a 60 day extension (if you haven’t had one already since last entering the country) first if you need time to sort out the Amphoe. You don’t need to be the legalised parent for 60 days.

Appreciate your reply. When u say they wouldn't accept the letter alone...what more would I get from the Amphur? My name is already listed at the father in the Tabien baan

I don’t have any first hand experience of this so I can’t give you definitive advice, but I believe that immigration offices require a document from the Amphoe.

 

Depending on the child’s age/circumstances an Amphoe can register your parenthood without court orders/judgement. I think it’s the registration of your parenthood at the Amphoe that counts.

 

I suggested it might be worth asking as you do have an official court document.

You will get an official paper ( Kor Ror 11) where you are named as the legal father and that you have patental rights. This paper you need to get an extension of stay being the father of a Thai. It would be wise to approach the court again for sole custody. Otherwise the mother can always make trouble for you.

I went to immigration this morning and they told me my court order was all I needed. I asked him if he was sure and he said yes. I doubt very much they would cross reference and check with the amphur. Mind you they told me last year my name on the birth certificate was enough and of course it wasn't.
