My Stepfather and Mother are hoping to apply for a Non immigrant Visa in June from the UK based on retirement 800,000 combined with pension

I was looking through the requirements and noticed the following statement

  • If you wish to be accompanied by spouse, the marriage certificate will be attached. But your spouse will be granted Non-Immigrant “O” instead of “O-A”(Long Stay)
  •  

does that that mean my step father would be granted 1 year stay and my Mother would only be allowed 90 day stays which is what I thought a Non immigrant ‘O’ was ?

 

They both plan to stay in Thailand indefinitely I am now confused to what they should apply for from the UK for their first Visa based on retirement. I thought the spouse was always granted what the equivalent status of the main applicant would receive ?

 

advice needed please

Your mother would be granted an extension of stay which would match that of your father. Make sure that your parents have their marriage certificate authenticated by the UK authorities and the Thai Embassy prior to their leaving the UK.

Your mother can apply for an extension of stay at immigration based upon your father's OA visa entry for being his wife. The extension will be valid to the date your fathers one year entry ends.

Thanks for the speedy reply, so in short my Mother would need to report in a local immigration office in Thailand before her first 90 days are up, and then her visa would be extended to match my stepfathers ?? 

Is that correct

Swimman, thank you for your reply,

so do they need to get their original marriage certificate authenticated by the UK FCO before making the application in the UK ? and then slip a note in with the application asking the "Thai embassy to authenticate the authenticated certificate " for further extension once in Thailand ??

sorry if that sounds confusing

The legalization does not need to be done when apply for the visa at the embassy. It is only needed for your mother to apply for the extension at immigration.

That is correct. She can apply for the extension of stay during the last 30 day of the 90 day entry from the non-o visa.

Why would the need to register their marriage here? It is certainly not a requirement.

I never suggested it was a requirement but situations change and having UK documents legalised from Thailand can be problematic.

As I see things. situations would only change sufficiently as require their marriage to be registered in Thailand if either party were seeking an extension of stay based on marriage to a Thai national, which is never going to happen except in the highly unlikely event of one or other of them being granted Thai citizenship!

Legalising a document and registering a marriage are two different things. It's not necessary for foreigners to register their marriage in Thailand, and I don't think it would be possible.
