I guess she just meant military rule.

I guess so also but she didn't say that.   And guessing what posters say on here usually brings a barrage of attacks.

No sympathy 20yrs ago he would have faced the death penalty, tell the poor little mummy’s boy to abide by the laws of the land in future. I do hope they didn’t hurt his feelings too much there, there didums.

He may have been told that by others but, no, the reality is that they would not be charged for overstay if they were detained by authorities.  Martial law was lifted in Thailand in April 2015.

Just Weird,

I agree with you unless Thai law has changed dramatically recently without my knowing.

When a person is ' on bail ' he/she are allocated an Immigration officer so that they stay within the Thai law regards overstay.I have seen first-hand immigration officers go to the court of first instance, where they go to the court clerks office with the defendant to see there is an ongoing case.

Their passport is stamped and records updated after they get a paper from the court to state their case is ongoing and not yet concluded.

This procedure is repeated when an extension stamp is due to expire until the conclusion of the court case, so in effect, they do not go into ' overstay '

Many times in the past, this information was not offered by Immigration and it was the defendant's job to find out and report themselves to Immigration or through a lawyer to ensure they stay within the law. After all, until you go there and tell them, Immigration doesn't know you have a pending court case, you could just be somebody on overstay!

Regards Immigration Detention Centre in Bangkok, one of the worst places imaginable with people forgotten sometimes for years,  especially when they have no funds to live off or for onward tickets to get back to their own countries.

There are always consequences for any change. It should be inscribed on any young tourist's forehead that drug possession in Thailand (and other SE Asia countries) is ILLEGAL and if caught then there are harsh penalties including long-term imprisonment (and if found guilty of trafficking it could be the death penalty in other countries).

It should be a salutatory lesson.

Don't believe that for a minute.  If someone is arrested and detained by the police Immigration Dept has a process to cover them while they are detained as the overstay is beyond the arrestee's control if the detention passes the expiry date of their visa.  Detainees do not have to arrange and pay for those "extensions"!

Why do you keep contradicting the Guy, he has nothing to gain by Lying, he has just been thru the process with his Son, he is simply trying to educate and inform and warn others as to the CURRENT CONSEQUENCES and the corrupt Judicial system, why dont you accept that instead of trying to show us all what a Smart Ass you are, your Pathetic.

Don't let us get sexist about this, it doesn't make any difference these days as nobody seems to know what they are, or care.

As far as Thailand police immigration and prosecution is concerned, and depending on where the person was arrested, they are capable of choosing/changing what route to take in regards of visa expiries, overstays or whatever, so I wouldn't take anything for granted except to have plenty of dosh to cater for any 'get out of jail free' contingencies.

Lucky this guy had the necessary.

yes, was a little giggle that's all. Things happen, she should accept what is, resisting 'what is' is pointless and causes internal turmoil. Her son is done with the situation that he himself caused, she should be grateful that the ending wasn't worse than it was.

I agree it is insane that there are such penalties for grass/weed/ marijuana/ jung  gui  or whatever it's called.

Hopefully that will change  after enough silly idiots die off.

The reality is drugs are against Thai Law and punishment can be servier.

They all know this, It is no use crying over spilt milk, You take your chance, you pay the price. Which he did.

I am 76 and on perminant medication, I live here and go back to New Zealand 2-3 times per year, I come back with my medication, I declare it every time and show my doctor prescriptions.

i do not take a chance on anything with Thailand.

No I am not condoning his actions at all - I am livid with him.

As for the 2nd point, he would have been charged with overstaying, this is now the procedure, two people he met in a similar situation did not arrange and pay for  a visa extension and were charged 20000 Thai baht for overstaying  on top of their fine for the drugs

Hi,

I think the possible confusion may be that the two people he met did not go and tell Immigration immediately upon release on bail that they had been arrested, bailed and had upcoming court appearances.

If that was the case and there was a substantial delay in notifying the Immigration authorities of their predicament, it is possible that they went into overstay and got no assistance from Immigration until that matter was resolved.

If they reported themselves to immigration within a reasonable timeframe, it would have had to be accepted.

Seems very harsh banning your son for life for some cannabis in my view, when they have so many bigger issues they are not addressing, but their laws and their country I suppose.

Well,..T.I.T. this is Thailand, there are the laws, and there is the reality !!!

Can confirm that there is a working system in place for those people caught up in legal proceedings in Thailand, whereby they are NOT charged for overstay simply because they did not have access to their passport and we're unable to leave at the time their original leave by date expired.

The earlier post by the OP saying her son would have been charged overstay is simply incorrect.

Anyone who messes with drugs, anywhere in SE Asia must be a slate short of a roof. Penalties can be draconian and the person cited by the OP was very lucky.

don't commit the crime if you can't do the time.

Mum mentions she had lawyer,,,, probably lawyer filling mums head with rubbish to gain more payments...at least that what it sounds like to me.

Everyone going to Thailand knows how strict the laws are in the Kingdom. He was lucky. Because of such cases, the Farung community is being tainted.

Farung back, he should be banned from returning.

So incredible that it was not possible to bribe his way out on the most corrupted place of the Kingdom.

It seems that when idiots in uniform do not accept money, it is because they already got too much the same day, and they want to show that they are somehow working.

The full story is crazy, and I wish the worst to anybody thinking that it's acceptable to make so much trouble for weed.

IDC is a terrible place it can hold up to 80 people and that was in room 2, you would be locked up for 4 days and let out for 2 hour exercise and to bye  items if you had noney many poor people have been in there for years. I KNOW BECAUSE IVE BEEN THER AND DONE IT.

Hi folks

Please remember that Mum2 is talking about what happened to her 18 year old son as a result of his own stupidity.  She is not making any excuses for him, or looking for any sympathy.  All she has tried to do from the start was to make others aware of the pitfalls of becoming involved with illegal substances in Thailand.

No doubt she has been through 2 months of ‘hell’ and certainly does not deserve to be castigated for her son’s foolhardy actions.

I sincerely hope that her son realises what pain and anxiety he has caused his mother and makes amends to her.
