Been here 4 years. Have extended my OA visa in the past based on retirement. I now have a Thai son. I am the legitimate father through the courts and everything registered at the Amphur and finalised. My son lives with me and has done since birth. I was not married to his mother and she is for all intents and purposes uncontactable. I assume I don't need her signature or approval to get my visa?

 

Can someone run me through the process of extension?

I believe only 400k Thai baht is required and it only needs to be in the bank the day you apply?

I have heard the extension isn't granted the day you apply and the application is forwarded to head office for approval.

So does this mean you need to allow time for the application to be sent away and approved. For eg I apply 2 days before my visa expires and head office takes 2 weeks to approve it. Technically I would be on overstay.

Not needing to have the 800kTHB in Thailand for 3 months would be advantageous to me.

 

How does it all work? Is it a hassle or am I better off just doing the retirement thing?

The written rules do not require the 400k baht in the bank for 2 months on the date you apply but some offices will require it.  You also have the option of proving 40k baht income to apply. You will be applying for an extension of stay (not a visa) based upon being the parent of a Thai.

When the application is accepted you will be given a under consideration stamp with a report back date 30 days from the date you apply or 30 days from the date your current permit to stay ends. The under consideration stamp allows you to stay until the application is approved.

You will need photos of your child in and around the house and one with the house number showing. Map to your house.

What is needed varies office to office. I suggest you contact your local office to find out what they will require.

Thanks Joe. I thought written rules one day. My office Khon Kaen telling us one month.

So what happens if your application denied? I should be ok i think everything genuine

If your accepted extension is denied you will be given 7 days to leave the country. It is a rarity for them not to be approved. Normally if there is a problem they will contact you to get it sorted out.

If the extension for having a Thai child is denied, could he still at that point apply for another extension based on retirement (without leaving Thailand)?

Technically not since the police order states if the application is denied only 7 days is granted.

It would be up to the office where the application is done whether they wanted to be flexible with the rules or not.

So if I extended based on my child...and got the stat Dec from the Aus embassy to say I had income of 40k baht per month....rather than 400k in the bank....I still need to wait 2 or 3 weeks for approval from Head Office?

How long it takes for approval depends upon the regional division headquarters it is sent to and when it is sent to them. I can even take longer than 30 days to get the approval but the under consideration stamp allows you to stay until it is approved.

In the past I have used the Guardian extension without any difficulties.   Within the past week (May 2018) I have been checking this up for a friend who may need to go through this route.   Three Thai legal firms web-sites say 500,000 is now required but just one states that income may offset the 500,000.

ThaiVisa had a translation of the Police Order (c2014) available.   See attached - section 2.18.   Can't find an update.

Part of the problem is calling it a guardian extension. It is really an extension based upon being the parent of a Thai.

The confusion arises since there is an extension based upon being the parent of a foreign child attending school here under clause 2.11 of the police order that requires 500k baht in the bank for 30 days for the first extension or 90 days after that. There is no income option for that extension.

So, presumably, if the office decided not to be flexible, the applicant would need to leave Thailand and return with a fresh non-O visa (or tourist visa/visa exempt followed by a non-O conversion) before he could apply again for a retirement extension?
