Hi there

I'm a Filipino with a 1 year visa and work permit here in Thailand.

Last year, I asked my Mom to come and stay with me for awhile. She stayed for about 3 months on a visa on arrival 30 day stamp doing a re-entry at Poi Pet, Cambodia. Until she went back to Manila in November last year flying out.

The following month, I asked her to come back and spend Christmas here and she flew in back to Bangkok airport and got another 30 day visa on arrival. Since I am moving to a new condo and she wants to help me get things done, she went back to Cambodia for another 30 day re entry.

Unfortunately, the immigration officers numbered her previous re-entry stamp to #1, #2 and her latest entry as #3.

So I guess, she couldn't extend anymore as I know from the new rules she has to fly out at the end of this new 30 day stamp.

Now, our problem is that on the 30th day which is Feb 18, she didn't fly out and instead went to Suan Plu and got her 7 days visa extension to be expired tomorrow.

We cannot book her to any flight back to Manila for tomorrow....and our plan is really for her to fly with me on Feb 28 to Hong Kong.

But her current visa stamp is only Feb. 25.

Is it okay for her to overstay for 3 more days and fly out with me on Feb. 28?

I heard that w ecan just pay 500 THB per day of overstaying so that's 1,500 THB when we fly out on Feb 28 right?

Is this safe? Just to pay for overstaying? She's kinda worried that they might put her into jail...and I told her you have no violation except overstaying and pay penalty fee. But we need some assurance.

Or should she just go back to Cambodia tomorrow and try to get another 30 day stamp even though she already consumed her 3X stamp (90 days stay?). In reality, she has been here only 2 months she last flew in.

Please advise me asap the best solutions.

I think it should be okay no? I am now thinking of personally accompanying my mother on this trip so in case she gets questioned, I will assist her.

Also, my friend Doctor say she can issue a Medical Certificate that my mother was unfit to travel in the past week due to heavy flu or something, just a back-up.

But many have told me that 3 days should be okay...and just pay the penalty at the airport.

In post one you say you will travel with her to Hong Kong on the 28th but now you say you are "thinking of personally accompanying" your mother this time? I would obtain flights to Hong Kong tomorrow and not put your mother at risk; however slight that might be.

3-6 days not a problem. 500 Baht per day fine. Pay at the airport and off you go.

Be very careful to not get stopped before you get to the airport.

We are both booked for a Feb 28 flight to HK. I don't think I can fly her out today.

You think she can just pay 3 days penalty and should we be okay at the airport? We will be together so I will definitely accompany her.

Yes, but you take the chance of being stopped on the way which will mean big trouble.

I don't know what anyone else thinks of this idea, but you might like to get her to try and get a further 3 day extension at Suan Phlu. With the confirmed flight ticket and being as she's an older woman and not appearing like a farrang lay-about, they might let her extend for 3 further days. Could be worth a try anyway, perhaps...

Actually, maybe best to forget that idea as by the time it will be open (tomorrow), her visa will be expired already anyway...
