Consumer Laws

I really don't know where to post this and I can not fine any related topics anywhere:

My problem is as follows: I have an AJ DVD that I purchased in Power Buy in MBK 10/06/2006. In December the tray wouldn't open and on the 28/12/2006 we returned it to the shop for repair under the guarantee and they told us it would be ready within 14 days. But of cause it wasn't ready and they told us it would take one more week. Since then I have contacted the shop at least once every week by telephone and we get all kinds of lame excuses about the supplier keep on sending them the wrong parts for the repair. Today we called again and still nothing - isn't there anything in the law that protects me? Where I come from, Denmark, we have laws that guarantees the consumer swift repair within the first year or a new item ( repair is only if the cost of a new product is mush higher than a new item)

Hope somebody can help me, I'm getting really frustrated

The only answer I can offer, is to buy brand name products like Sony, Panasonic etc

where the company is well represented in Thailand and has a chain of repair centres.

The dept stores are notorious for their slow service when repair is needed.

Never deal with the shop you bought it from. They have to go through all sorst of channels. Just go direct to the importer or manufacturer. Works best. They have there own service centres and speed things up a lot.

I went through the same thing many times untill I had enough, demanded the items back and went straight to the source.

I have been trying to locate the manufacturer of AJ but it is difficult, I can not locate them on the internet but think the mother company is called something with Crown

From a legal perspective here in Thailand:

There are many provisions in the Civil and Commercial code which you 'could' apply to the sales of goods but unfortunately this wouldn't get you very far. To add to the grief there are no specific Acts in place as yet regarding a contract for the commercial sale of goods under Thai law. Therefore consumers here pretty much have no protection. In some cases you could rely on the application of the general rule of Convention on the Contracts for the International Sale of Goods but I doubt would get you very far with the average street trader.

As someone pointed out, the best thing to do in Thailand is to rely on the warranty that comes with the product straight from the manufacturer and to register what ever it is your bought direct with them and resolve any problems that way. **IF** you didn't get a warranty card then you are pretty much snookered and although you 'may' be offered a replacement, the chances are they will only offer to repair it 'for a cost'.

I have a valid guarantee card which expires on the 10/06/2007 and I thought that Power Buy in MBK was reliable since it's a big shop but now I would advice everybody not to do their electronics shopping there

I might be wrong but I believe it's Chinese ! I've seen them in Shenzhen. You could have serious difficulty locating the importer/agent and even if you can, chances are they won't help you.

I think you need to keep on at Power Buy. See if you can get a refund or maybe a replacement. If you make enough trouble for them it might work.

As far as the question about consumer protection goes - there is very little. This is one reason why there is very little small claims litigation here.

There are many "brands" available throughout asia that you will never see in western countries due to the general quality amd non-compliance with standards certain standards.

As another poster noted, stick with well known brands.

Just tell them you're returning it with your full refund under the warranty.

Next, go to another shop and buy a new one.

Like that will work...

Thailand must be one of the few places I know that actually says on the till receipt 'no refunds' will be given.

I think some places try and screw you here. I bought a Soken DVD player about 6 months ago. Best Buy showed me this horribly scratched VCD and showed me how it plays it perfectly. The guy said it plays damaged VCDs. I bought and it barely plays any VCD I rent. Almost every VCD skips a ton and it doesn't play half the DVDs I rent. It also doesn't play copied VCDs. Its a piece of shit and fairly expensive compared to DVD players back in the States. I swear the guy new it was a piece of shit.

Another thing in shopping in Thailand is the sales in clothing when they don't let people try the clothes on. I don't understand the point of it. It just shows me that the store doesn't care about their customers. Why would a store want to sell clothes to people that may not fit and also have no refunds or exchanges if it doesn't fit when you get home. They are trying to screw people over. Terrible customer relations.

You can say the same about Tesco Lotus, Big C, Home Pro, SR, Macro, and the rest of the big companies here. They will not repace the faulty product or give a refund. If you are lucky you will get a repair that maybe will fix the problem.

Where on earth are you shopping. I get to try on all the clothes before I buy and have never had any problems. If they don't let you try, then don't buy.
