Reentry on Retirement Visa..do I need to go to immigration today?

I hate to ask, but I don't want a fine.

I'm on a retirement visa and returned yesterday. I'm at an AirBnB for 3 nights and then getting a new condo on Sat. Do I need to go report myself back today and then report the new address on Monday??

It depends upon the office you will be reporting to.

You may need to do it 2 times to avoid being fined.

Some offices are more flexible and might not fine you if you report your residence for the condo on Tuesday (immigration is closed on Monday).

This is where it all gets very stupid.  You will not be able to do a TM 30 for the AirBnB.  That is the owners duty.  The only thing you can do is the report for your own place.

I do not know what will happen to all the AirBnB renters under the new enforcement of the TM 30 rule.  I not sure where it leaves you.  Maybe they will start getting fines for not doing T 30s  Ask the guy you are renting from as to if he will file a TM 30

or maybe TM 28 as well

So I went ahead and went to immigration...I'm in Chiang Mai.  FYI - I was just informed that the main area of this immigration office is now open weekends and holidays as well!
My last landlord didn't file her TM30 on time at my old place and I ended up having the pay the fine even though it was her responsibility (long story that I won't repeat because it pisses me off).

Found out my AirBnB owner lives in China and isn't able to do TM30s. I think this will cause problems for AirBnB owners in the future!

I reported myself and will go do a change of address next week...the people I spoke to said it was fine???? if I didn't get there until Tuesday.

Since I'm on the retirement visa and I had the mishap with a previous landlord, I thought it was best to go in. I probably could have done it all after the move, but that reporting within 24 hours of arrival had me concerned.

For a clearer understanding of the legal responsibility to submit the notification with the form TM.30, you may want to read section 38 of the Immigration Act and the definition of House-Master in section 4.

But, there is a category when you register to do TM 30 online called possessor. I think this means that a renter can report on himself

Yes, that's in sections 38 and 4 of the Immigration Act. In the quote below from section 4, I have highlighted in bold the definition of House-Master as applicable for a rented residence.

 

House Master ” means any persons who is the chief possessor of a house whether in the capacity of
owner , tenant , or in any other capacity whatsoever , in accordance with the law on people act.

 

Therefore, in section 38:

House-Master = tenant

Owner = owner

Possessor = tenant

Oooh. Now that's a good post.  Many air BNB folks are overseas, with more Chinese coming on board as reports show they buy properties to rent out. 

Yes, the foreigner might even find it more difficult to rent property because of the added paperwork and trouble. They expected my owner to turn up in person to file the TM 30

Assuming offences aren't cumulative, the best solution may be to kick the can down the road for as long as possible, at which point they might have managed to get themselves organised. If a fine looks to be inevitable, I'd be inclined to delay it until I had no option other than to visit immigration on some other business. Most people affected are likely to be completely unaware of this rule anyway, until immigration informs them about it directly.
