Trump administration loses bid to lift bar on funds for border wall

(Reuters) - A federal appeals court on Wednesday refused to lift an injunction barring the Trump administration from using $2.5 billion intended for the fight against illegal narcotics to build a wall along the southern U.S. border with Mexico.

 

The ruling was another setback in President Donald Trump's effort to construct a border wall, one of his top promises in the 2016 presidential campaign. He pledged at the time that Mexico would pay for it.

 

"Congress did not appropriate money to build the border barriers defendants seek to build here," a three-judge panel of the 9th U.S. Circuit Court of Appeals said in a 2-1 ruling.

 

"Congress presumably decided such construction at this time was not in the public interest. ... It is not for us to reach a different conclusion," the panel said.

 

Trump has been unsuccessful in persuading Congress to fund the wall. In February, the president declared a national emergency, saying that would entitle the administration to reprogram $6.7 billion in funds Congress had allocated for other purposes to build the wall.

 

Several states, including California, and organizations, including the Sierra Club and the Southern Border Communities Coalition, challenged the administration decision in two lawsuits.

 

A U.S. District Court judge in California ruled last Friday that the Trump administration's proposal to build the border wall with money appropriated for the Defense Department to use in the fight against illegal drugs was unlawful. The judge issued an injunction barring use of the funds for a border wall.

 

The Trump administration appealed the decision on Saturday and asked that the injunction barring use of the reprogrammed funds be stayed pending the outcome of its appeal of the court decision.

 

But the three-judge panel rejected that request on Wednesday.

 

"We conclude that the public interest weighs forcefully against issuing a stay," the panel said. "The Constitution assigns to Congress the power of the purse. Under the Appropriations Clause, it is Congress that is to make decisions regarding how to spend taxpayer dollars."

Actually Congress thwarted him and the court upheld that, which was a pretty obvious conclusion.

Congress spent more than 40 million dollars attempting to overturn the 2016 election.  They are still not giving up their Russia! 

 

One disgruntled Federal Judge has more authority than The President of the United States.  Most people are aware by now that the 9th Circuit Court, located on the West Coast is made up of Obama appointees...

 

These judges cannot be trusted to set politics aside in their unelected offices...this lone judge political power tripping situation needs to be revised...

That money was spent by the DOJ, not congress.

The order was signed by Judges Richard Clifton, appointed by President George W. Bush, and Michelle Friedland, an Obama appointee.

The wall is a stupid idea that won't stop people smuggling or illegal immigrants getting to the US. It'll also have no affect on the 'war on drugs'. As such it's a complete waste of time. Now, if the US stopped destabilising countries in the region, that might make a difference, as you're turning off the tap at the source.

As a strong proponent of border security I see the only mitigating factor in nothing getting done is Mr Trump himself. He is continually in a fit of pique and blames all but himself. He has instituted a long string of desperate policy ideas that he thought would prevent migrants from entering the United States, and each has failed. To be a successful POTUS you need to build consensus and unanimity not division.

He has yet to discover that the president of the United States doesn’t have the unilateral power he imagined.

We will see 2020 won't we? it's not a forgone conclusion but he is only President because of Dems utter failures (and should not be I grant you... but a huge slice of America, and the world, do not want pc libralism and choose the obnoxious opposite to make that stand).

One can never brush aside the inherent stupidity of people when it comes to "their" president. But that is not restricted to the US it seems to be a global phenomena

I would suggest with much reverence you read my post again and explain to me your comprehension of what I said and attempt to justify your pique.

By the way I still am a registered Republican and left US when Obama became president in 2008- choosing  in 2016 not to live under Trump either.

Your suggestion was that people might make a stupid choice. As my post was about 2020 one might reasonably draw the conclusion you were referring to that.

really?....well what about the Berlin Wall or the wall Hungary have put up to keep illegals out or the Great Wall of China that kept the Mongols out or the wall in Israel....all of them are or have been extremely successful in maintaining the security of the country.....the fact is that the USA and most other Western countries are controlled by the enemies of the West who wish to see the end of the majority of white populations in their own lands and what is presented as democracy is just a puppet show
